Given the extreme gravity test generally refers to murder, and 3 out of 4 convictions were secured, and the case was prosecuted twice by specialist CPS Unit instructing a KC and Junior, I think you can sit this one out.
So the CPS are saying that the evidence of assault we can clearly see with our own eyes does not pass the 'extreme gravity' test for another go. Okay but I'm not sure we will pass the 'any call signs available' test either if cops see atrocious behaviour with no consequences.

I was original led Pros counsel in this (nothing to do with the appeal). My leader was James Gelsthorpe who sadly died later that year, aged 36. I would have shared this with him today. Since I can't, I'm sharing it here. A superb barrister and friend, still sadly missed.

No doubt lots of hard work/skill, but is description: "was fortunate to secure an open minded jury prepared to think about the real issues, rather than being seduced by the superficially attractive Prosecution case" really an appropriate thing to say in this context?
Jane Bickerstaff KC's client was acquitted of both rape & attempted rape after waiting since December 2018. The inordinate delay was due to police inefficiency in investigation and the effects of the pandemic. Read more: 9brchambers.co.uk/our-news-v… #Acquittal #Rape #Assault #Crime

Tragic to hear of James’ passing. Thoughts with all his family and those that were fortunate enough to work with him.

Best news theme ever
I love the BBC News intro theme so much. It’s like, at the end of this countdown you’re either going to hear about the day’s news or you’re going to have a heart attack and fuckin die

Yesterday, I was pretty upset. My client was convicted after trial and remanded. I waited 30 mins for him to be processed. He was young and first custodial. He is vulnerable. He was crying. After 5 mins I was interrupted and told by cell staff time up as the prison bus leaving.

I have spent many hours waiting for late prison buses to court, delaying trials, or where prisoners have not been produced when directed. There never seem to be any consequences for the provider of the buses or prisons.

The client will be punished having been convicted. And no doubt court cell staff just trying to do their jobs. But the lack of empathy and compassion, coupled with bureaucratic inflexibility, that the bus could not be delayed 5 mins, really got to me.
