THE SETUP 2008: new constitution. separation of powers for the first time. but the judges were gayoom's judges. appointed by his justice minister. some as political payback. of ~200 sitting judges, ~40 were graduates. not all in law. the rest had a 6-month certificate. so the constitution built in one fix. article 285. every sitting judge: two years' probation. by 7 aug 2010 the JSC had to check each one against article 149. qualifications. ethics. record. pass, you're a judge. fail, you're out. one chance to start clean. THE COMMISSION JSC had ten members. six had something to lose from a clean bench. chair: justice mujthaz fahmy. 6-month certificate. a 1998 corruption finding for pocketing MRf 900 overtime. he argued education shouldn't count. nor misconduct before 2000. he was grading himself. jan 2010: the one JSC member pushing for a real check, high court chief justice abdul ghani, was pushed off by three colleagues. feb 2010: the "standard" was written in three 90-minute sessions. a judge stays unless convicted of a hadd crime, breach of trust or bribery. nothing else. no degree. no ethics check. no screening. nobody opened the files. the files, per the one member who read them: judges who'd served criminal sentences and come back. findings of dishonesty. complaints of sexual offences against minors, unaddressed. an MP on the JSC, one of the constitution's own drafters, declared article 285 "symbolic". one word. that's what killed it. the speaker, also on the JSC, said nothing. THE FIGHT velezinee wrote to the JSC. to parliament. filed complaints. demanded an inquiry. parliament's committee met the JSC on 2 aug 2010 and refused to discuss 285. the president asked for a review. the chair put the letter in a drawer. 1,652 citizens petitioned. bin. MMPRC: $90m. 12 years. how much came back? rilwan: 12 years. who was tried? her 2010 files: magistrates trading child support for favours. complaint folders nobody opened. this isn't lack of evidence. it's a court built not to punish. and it's why we're Caa1. nobody lends cheap to a country where a contract depends on who the judge knows. so the state borrows at junk rates, taxes you to repay it, and calls the repayment an upgrade. the courts and the debt are the same problem. THE MACHINE 2014: yameen fires the chief justice, makes abdulla saeed chief justice. the man who ran the 2010 oath. 2025: muizzu's JSC suspends three justices an hour before a hearing. the court's been frozen since. same commission. same move. new owner each time. velezinee called 2010 a "covert coup". she wrote it down in december 2010. today MDP calls 2025 a "judicial coup". same word. fifteen years apart. opposite directions. everybody recognises a coup when it's done to them. this is why "let the public vote to remove judges" means nothing. judges aren't captured when they're removed. they're captured when they're appointed, confirmed, and left alone. 2010 proved it. 2025 confirmed it.
