THE COMMISSION JSC had ten members. six had something to lose from a clean bench. chair: justice mujthaz fahmy. 6-month certificate. a 1998 corruption finding for pocketing MRf 900 overtime. he argued education shouldn't count. nor misconduct before 2000. he was grading himself. jan 2010: the one JSC member pushing for a real check, high court chief justice abdul ghani, was pushed off by three colleagues. feb 2010: the "standard" was written in three 90-minute sessions. a judge stays unless convicted of a hadd crime, breach of trust or bribery. nothing else. no degree. no ethics check. no screening. nobody opened the files. the files, per the one member who read them: judges who'd served criminal sentences and come back. findings of dishonesty. complaints of sexual offences against minors, unaddressed. an MP on the JSC, one of the constitution's own drafters, declared article 285 "symbolic". one word. that's what killed it. the speaker, also on the JSC, said nothing.
