I'm excited to share my newest piece that shows how prosecutors are increasingly using criminal conspiracy laws to criminalize social movements and protests, particularly in the age of ICE, building on Steffen Seitz's excellent work, as well as responding to Andrew Ingram
New from Iowa Law Review Online is Conspiracy Paradigms: Response to Conspiracy, Really? by Laurent Sacharoff. Read this Response here: lnkd.in/gWkdr87u

I'm very excited about this chance to challenge one of the Supreme Court's least known blunders. Jones v. United States, 362 U.S. 257 (1960).
🧵The founders designed the 4th Amendment's warrant requirement to guard against executive abuse. But the courts have so eroded it that today warrants are more a mechanism to launder accountability than check abuse. @IJ's appeal in Mendenhall v. Denver seeks to change that. 1/

A second view, that Laurent Sacharoff has argued for in response to me, is that the implicit testimomny incluces what the government learns when the device is unlocked and searched. Under that view, the govt has to already know what's on the device for the 5A not to apply.
