This is problematic in many ways. The judge has no such power to impose her Christian beliefs and/or understanding of scripture. The only question the judge should ask is whether such beliefs (however obnoxious) were held sincerely and in good faith by the faithful. Otherwise Roho Ofwiny, Yesu wa Tongarenians, and many other traditional religious assemblies (and cultural practices) would have no place in Kenya.

You do not file a Notice of Appeal when appealing from the Magistrate Court to the High Court. You only file a Memorandum of Appeal and a Record of Appeal. Notice of Appeal are for appeals in the COA and SCORK
