Benson's own data manager just swore the list each precinct downloaded for Election Day "need not be uploaded" to the state database. Why? "It would be duplicative." (Clone Aff, par 14) Their theory: the State tracks every change, so the list can be rebuilt later. Here's the thing. Reconstruction is not preservation. It’s DELETION with a RECEIPT. The next day, the United States filed in the case and told the Court that poll book data are federal election records, and the Secretary of State is responsible for keeping them. It also said that IF the Secretary is right that everything gets uploaded, prosecuting the clerks who deleted wouldn't be a priority. But own data manager just swore it doesn't all get uploaded… Delete or keep? The court record is now complete and now the judge decides.
