Sussex Law School in São Paulo 🇧🇷!
Yesterday, we hosted a workshop with @Insper on platform regulation in Brazil.
We discussed disinformation post-2024 elections and the concept of "duty of care". Key takeaways will be in a policy brief soon.
A huge thanks to all participants!
Great discussion on duty of care & platform regulation yesterday in São Paulo!
Thanks to all who braved the rain and traffic ☔️
Key takeaway: duty of care is a powerful framework that can enhance but not replace other forms of platform regulation - incl. liability rules.

When should social media platforms demote harmful content instead of removing it? Our new working paper (with @beakira and @louisa_bartolo) explores this issue -- feedback welcome! papers.ssrn.com/sol3/papers.…
New open access summer article out☀️
"When non-consensual intimate deepfakes go viral" argues this form of image-based sexual abuse is the primary current AI risk, but current legislation - incl. Online Safety Act - fails to protect victim-survivors.
🔗doi.org/10.1016/j.clsr.2024.…
My article argues for banning all AI-generated intimate deepfakes - not only non-consensual - an idea the new UK government @10DowningStreet seems to support.
AI tools should also be required to have content comprehensive & enforceable moderation systems - much like platforms.
For a summary of the key points, see this @Verfassungsblog post highlighting the gendered harms of non-consensual intimate deepfakes (NCID) and calling for more effective prevention and mitigation measures from internet platforms and AI companies➡️verfassungsblog.de/deepfakes…
New open access article 'The Bypass Strategy' with @ellenejudson & Jeff Howard @digitalspeechX now out in the Journal of Media Law.
We argue that the Online Safety Act is driving online platforms to adopt a 'Bypass Strategy' of over-moderation, threatening freedom of expression.
We propose solutions to help @Ofcom refine its OSA guidance and protect free speech. Our research calls for clear standards on how much (and what type of) illegal content it is tolerable for platforms to have and how this will be practically assessed.
doi.org/10.1080/17577632.202…
We also see an opportunity for the newly elected UK government @10DowningStreet to reform the Online Safety Act and require platforms to assess and mitigate risks beyond illegal content – incl. negative effects to fundamental rights and to civic discourse and electoral processes.

Profoundly honoured to receive the Danilo Doneda Award for my work on digital regulation coordination.
Danilo was a dear friend, mentor & passionate advocate for cooperation mechanisms. I'm humbled to contribute to an agenda he held so dear. Huge thanks to @cpdplatam for this!
These developments bring to the fore the importance of regulators working together to tackle issues arising from digital platforms.
As I argued in the article, to do so they need to be strong, independent & well-equipped.
