The Supreme Court of Canada has agreed to hear the federal government’s appeal in the Emergencies Act case. We are now gearing up to defend our historic victory for the rule of law. This challenge was never an endorsement of the “Freedom Convoy” protests. Because of the protracted timeline and the extent of the disruption, we agreed that the police should have used ordinary laws to dismantle the blockades in February 2022. This case is about a fundamental democratic principle: even in times of crisis, no government is above the law. Last January, the Federal Court of Appeal agreed with the CCLA that the federal government had failed to meet the stringent legal thresholds required to invoke the Emergencies Act. When unlocked, the Act’s extraordinary powers enable Cabinet to enact wide-reaching orders without going through the ordinary democratic process. At a time when democratic institutions and fundamental rights face growing pressure, challenging government abuse is more important than ever. The federal government acknowledges that Bill C-34, which would ban children under 16 from social media, could affect freedom of expression, privacy, and equality rights, but insists the legislation complies with the Charter. NEW: The Pentagon has granted the Department of Homeland Security permission to test a heat ray weapon at the southern border. The military-grade heat ray can shoot an invisible beam of electromagnetic waves at potential intruders. The weapon can reach people more than half a mile away, according to the United States military. According to the Pentagon, the heat ray weapon is non-lethal but causes a burning sensation on the skin that can last between 10 and 15 minutes. The weapon sends an uncomfortable tingling effect on a potential intruder, generating "an instinctive and irresistible urge to run from the effect." Officials say the feeling is similar to the blast of heat you receive when you open up a hot oven.
