The joint-employer standard is one of the most critical issues in labor law today—affecting millions of Americans in nearly every sector of the economy. Uncertainty over the standard undermines job creation & economic expansion. The new @NLRB majority intends to get the job done.

The regulatory agenda is a Chairman initiative, not formal NLRB action. I'll approach any proposal w/ an open mind, but urge the majority to deliberate carefully, allow public input, and abandon the “decide first, ask questions later” approach from Miscimarra’s end-of-term.

.@BernieSanders told me he still sees EFCA as a huge missed opportunity. His new bill would create card check, ban right-to-work and do a whole bunch more for unions. Some big-name Dems are on board. huffingtonpost.com/entry/ber…

EFCA is back! Card check, mandatory arbitration of first contracts, ABC test for ICs, indirect control for JE, persuader expansion, reducing number of supervisors....its all there. Messaging bill now but different story if chambers flip. xitter.cf/josheidelson/status/99…
“Uber & Lyft are transportation companies,” says former NLRB chair. “The drivers are obviously providing the transportation services that Uber and Lyft offer the public.” Under new CA standard some want to take national, that makes it hard to claim those drivers aren't employees xitter.cf/josheidelson/status/99…

Mourning loss of John Ferguson, Assoc. GC & head of enforcement litigation -one of the smartest, nicest and most humble persons one could ever have the privilege to know much less work with. His absence leaves a big hole in the heart of the NLRB. Our thoughts are with his family.
