Trump’s press ban is back in court today just as the TRO that restored White House access to MS NOW, CNN, and Politico is set to expire.
Lawyers for the news organizations will argue that Trump’s ban is unlawful under the First Amendment and the due process clause of the Fifth Amendment and should remain blocked indefinitely.

NEW: The USS Spruance is finally headed home, per a sailor aboard the destroyer & USNI fleet tracker.
The destroyer was deployed to protect the USS Lincoln but remained in the Middle East after the Lincoln left. It faced many of the same conditions reported aboard the carrier.

BREAKING LINCOLN LATEST: The USS Abraham Lincoln will officially return to its homeport of Naval Air Station North Island in San Diego on Thursday, Oct. 8, ending a grueling 10-month long deployment.
NEW: The 49th annual Kennedy Center Honors will be held at Capital One Arena in D.C. Dec. 7, a Kennedy Center spox confirms to MS NOW.
The honors are usually held at The Kennedy Center. The venue change comes amid legal battles w/Trump admin over the center’s name & operations.
Last night in Oklahoma, @POTUS claimed Iran was manufacturing drugs at the nuclear facilities the U.S. struck last June in "Operation Midnight Hammer." I asked the WH what evidence POTUS has that proves Iran was indeed manufacturing drugs & was told: "refer to POTUS' comments."

NEW: Judge Todd Edelman has dismissed the reflecting pool vandalism case against former Olympian Davey Hearn with prejudice. This means the DOJ cannot revive these charges. They had been trying to dismiss the case without prejudice, so they could revive the case if new evidence came to light.
