SEC 70114 is unconstitutional.
• Introduced by @MikeCrapo
• Limits deductions to 90% of losses.
• Win $100k / lose $100k → IRS taxes $10k you never kept.
• The 90% cap violates the Sixteenth Amendment because it taxes something that is not “income.”
• Under Eisner v. Macomber (1920) income must be a “gain derived” from capital or labor.
• Under Commissioner v. Glenshaw Glass (1955) it must be an “undeniable accession to wealth, clearly realized, over which the taxpayer has complete dominion.” When a gambler’s wins and losses net to zero, there is no accession (increase) to wealth.
This phantom "income" tax will go into effect starting tax year 2026. @repdinatitus is working on a bill that would reverse this unfair anti-gaming tax provision. Let's hope common sense prevails and this is quickly reversed before 2026 gets here.

Trumps “Big Beautiful Bill” will not be beautiful for sports bettors 👎
I would owe over $55,000 in taxes! (2026)
Let’s use myself as a real life example:
I have made $15,628.24 half way through 2025. I’m going to double all my numbers to simulate a full year of betting
Assuming my ROI stays at 1.52%
My total winnings = $2,055,031.58
My total loses= $2,023,795.10
Profit = $31,256.48
For the 2025 I would pay about 24% in taxes on my total profit so $7,501.56 in taxes. Making my after tax income $23,754.92
If this bill passes and I use the same numbers in 2026 then I would only be able to claim 90% of my loses.
Total loses $2,023,795.10 X .90 = $1,821,415.59
Total winnings = $2,055,031.58
Total loses = $1,821,425.59
Profit/lose = + $233,605.99
If I owe 24% in taxes on $233,605.99 I will owe $56,065.48 even though I really only made $31,256.48.
That will net me -$24,809. How can I be taxed more than I profited? This bill will destroy the gambling industry. Make sure you spread the word.

If you have YouTube TV, go to settings, select the broadcast delay, and choose decrease. This removes the 15-second delay …. I just learned this the other day, and it's a literal game changer

It's pretty insane that with all the taxes we pay in the US, you still have to spend $1500+ for daycare per kid every month until they turn 5, unless one parent decides to stay at home full time

BREAKING: Total US stock market capitalization has hit $60 TRILLION for the first time in history.
Over the last 4 years, the value of the US market has DOUBLED.
By comparison, Asian and European stock markets are worth ~$18 and $15 trillion, respectively.
If this trend continues, the US market will be TWICE as large as Asia and Europe combined as early as next year.
To put this into perspective, the US stock market accounts now for 202% of the US GDP, the most on record.
The US market is incredibly hot.
