Balram Patel’s family say CQC closed the case without clear answers about a documented urgent second-opinion request, IV/non-oral treatment which consultant evidence said would have been capable of prolonging his life and relieving his symptoms, and a GP email sent approximately thirteen hours before his death which attributed wishes to a disabled man lacking capacity. The family say Balram could not have expressed those wishes in the form recorded, that no clear contemporaneous source or capacity-based foundation has been identified, and that the same email was used to question whether his father should continue the lifelong advocacy role he had fulfilled for Balram since birth - more than thirty years - and to propose replacing that parental advocacy with a learning-disability key worker. Parliament was already involved. On 8 September 2025, the Department of Health and Social Care told Sarah Sackman MP that CQC was reviewing inquest material and was continuing to review whether the threshold for a criminal investigation into Balram’s death had been met. Yet delay has now produced the very danger later identified in the High Court proceedings: even if CQC’s refusal were reversed, there may no longer be enough time for CQC to take a fresh decision, complete a criminal investigation and bring any prosecution before the 9 August 2026 deadline. On 9 August 2026, the third anniversary of Balram’s death, his family and Patients Lives Matter, supported by approximately 45,000 people, including many patients and families who report their own serious experiences of unsafe care, poor accountability and regulatory failure, will take the evidence to Downing Street. They will ask Parliament and the Prime Minister whether regulatory discretion and delay have become so broad that life-critical questions about disabled people, their safety, their wishes and their advocates can be left unanswered after death - and potentially left unresolved until it is too late for enforcement.”
