In our second episode, we break down Reverse Invoicing as provided for under the Tax Procedures (Amendment) Act 2024.
We caught up with @KWaruiru to understand the idea behind this provision.
A 🧵
The starting point was simple - why reverse invoicing?

In our kick off episode, we seek to break down electronic tax invoicing in Kenya with David Busaule (@DBusaule)
A 🧵
We started off with a historical perspective. It dates back to the manual Electronic Tax Registers rolled out in 2003

Missing Trader, a VAT-evasion scheme where a shell entity generates tax invoices to allow buyers to claim input VAT, but fails to declare or remit the corresponding output VAT.
I spoke about this matter at length with @DBusaule on @FiledPodcast by @DigiTax_Tech (be sure to follow us for more breakdowns).
Part of the reason for eTIMS embedding a stock management module (currently under stakeholder engagement) is to address the Missing Trader headache.
The Office of the Directorate of Public Prosecution has approved charges against 5 individuals & 12 companies linked to a scheme to defraud the government of Kes 3.9 billion worth of Value Added Tax (VAT).
The 5 are alleged to have been involved in registering 70 companies that were instrumental in executing the scheme.
Upon review of the files, the DPP approved prosecution in 36 cases involving transactions valued at approximately Kes 3.2 billion, resulting in an alleged VAT loss of about Kes 518.0 million.
If you are not sure where to start with the 'Missing Trader', see quoted tweet.

Helpful explanation. Invoice integrity only closes the missing-trader gap if the stock records behind each invoice are accurate, and that depends on what is actually recorded when goods arrive. Receiving discipline quietly underpins the whole eTIMS stock idea.

eTIMS created a digital trail, and analytics plus digital forensics connected 62,869 fake invoices to the same phones, devices and networks behind them. AI-assisted anomaly detection should now make such VAT-claim fraud easier to trace, prosecute and recover.

The Tax Procedures (Amendment) Act 2024 amended Sec23A of the Tax Procedures Act creating a window for reverse & buyer initiated invoicing to cater to the needs of small businesses.
Next on @FiledPodcast by @DigiTax_Tech, we comb through reverse & buyer initiated invoicing & what a taxpayer needs to know for their compliance purposes.
Also, what really is the difference between Reverse Invoicing & Buyer Initiated Invoicing?
I will be engaging @KWaruiru from @IchibantaxKE

What can taxpayers expect as the Revenue Authority plans to activate the Sock Management module on eTIMS (see quoted tweet)?
I had this chat with @DBusaule on @FiledPodcast:
Key take aways:
· The Authority is currently in a stakeholder engagement exercise
· The spectrum of stock expected to be captured includes, but will not be limited to, local purchases, imports, acquisitions that included existing stock
· There'll be need for code alignment to ensure seamless integration, the Authority uses the UNSPSC code
· The hope is that the Stock Management module will help the Authority address the perennial headache of 'Missing Trader'
UPDATE: The Revenue Authority says it will kick off stakeholder engagement on embedding a Stock Taking & Management module onto eTIMS.
The Authority says the stakeholder fora will take place within September 2026.
Musings:
1. This further tightens eTIMS & its use in incomes & expenses validation by the Revenue Authority
2. Once embedded onto eTIMS, the Stock Taking & Management module should grant the Revenue Authority of the movement of stock in a business
3. The import here is that if you are one of those who have been doing some sales without an electronic invoice so as to avoid visibility for tax purposes, your goose is cooked
4. At any given point, the movement in your stock will be required to align with the invoices captures in your iTax ledger & any misalignment will invite scrutiny
When eTIMS Regulations came out in Jan 2024, I captured this bit & how much clarity would be required (see quoted tweet)
