ICYMI: My latest for @the_lineca, which argues that (as @GuyJBaldwin and I have explained in greater detail) life-without-parole sentences should not be unconstitutional, contrary to what the SCC has held. readtheline.ca/p/leonid-siro…

My latest in @the_lineca is an argument that life without parole sentences are not unconstitutional, based on the paper @GuyJBaldwin and I have recently published in the European Human Rights Law Review (which you can read here: papers.ssrn.com/abstract=605…). Link in reply.

Remember when the Vatican spent 500 years trying to align the printing press?
New post: the PQ's proposal to "abolish the monarchy on Quebec's territory" is unconstitutional and profoundly unserious, but it's not the first time Canadian politicians pretend the constitution just doesn't exist if it gets in their way. doubleaspect.blog/2026/09/30…
Way back when, international law prof started his first lecture by saying "International law is for frustrated people". Finally someone has a concrete plan for changing that!

A brief history of Carl Schmitt in the English-speaking world:
1945-1991: "Carl Schmitt? You mean the crazy Nazi guy who wrote a bunch of self-contradictory authoritarian blather to justify Hitler? Why should anyone waste their time on such obviously ridiculous garbage?"
1992-2000: "Hey this Carl Schmitt guy may be a Nazi, but he has some useful ideas for our Marxist quest to dethrone neoliberalism, and that's useful for our purposes now that the Soviet Union is gone"
2001-2010: "The lefties may have rediscovered this Schmitt guy, but they've missed his real utility, which is justifying unilateral executive power during emergencies in order to fight the global war on terror!"
2011-present: "Well that GWOT thing didn't turn out so great. But we still like Schmitt and especially the exercise of power that he justifies. Let's merge him with theocratic integralism, even though he was an excommunicated degenerate, and just declare that we're Holier Than Thou, meaning nobody can question us when we try to implement his Nazi ideas under the borrowed name of the 'common good'"

The Macdonald-Laurier Institute’s Judicial Foundations Project is planning a one-day symposium on “Judicial Power and the Canadian Constitution,” tentatively scheduled for February 4, 2027, at Hart House, University of Toronto. We hope to bring together scholars, experts, and practitioners from across Canada, and potentially the wider Commonwealth, to reinvigorate interest in the development, scope, and exercise of judicial power in Canada.

Encouraging people to read Carl Schmitt without substantively discussing how his theories relate to Nazism is a bit like teaching a class on the history Marxism without ever mentioning the Soviet Union.

Over at her blog, @Akamalnath and I have a post about the Bar Council of India's chairperson's attempt to punish students for protesting against the Chief Justice of India. I'm no fan of law societies that can't stay in their lane. Neither is Dr Kamalnath. corporatelawacademic.wordpre…
