The EU is moving toward a more consistent approach to GDPR fines.
New guidance from the European Data Protection Board aims to reduce differences in how penalties are calculated across EU member states. That could make GDPR enforcement more predictable, but it also means companies may have less room to rely on differences between jurisdictions.
The bigger question: If GDPR enforcement becomes more consistent, are your privacy processes consistent enough to keep up?

California’s privacy landscape continues to evolve, with several significant privacy measures advancing through the Legislature.
Among the key developments:
• CIPA & website tracking: SB 690 would limit certain private CIPA claims involving website and app tracking.
• Deletion rights: SB 923 would expand the CCPA right to delete to cover non-exempt personal information regardless of its source.
• Sensitive data: AB 1542 would restrict the sale and sharing of sensitive personal information, including precise geolocation data, in specified circumstances.
• Data brokers: AB 883 would shorten certain compliance timelines from 45 days to 30 days.
• Children’s privacy: AB 2246 would replace California’s existing Age-Appropriate Design Code framework with new requirements for online services likely to be accessed by children.
What happens next? The bills that passed the Legislature move to the Governor for consideration. If signed, most would generally take effect January 1, 2027.

Delaware’s privacy landscape just changed.
On September 2, 2026, Delaware signed legislation expanding its consumer privacy and data-breach laws. The updates broaden the scope of the Delaware Personal Data Privacy Act and introduce new considerations around AI, profiling, sensitive data, third-party data recipients, and consumer rights.
For companies operating across multiple states, the bigger takeaway is clear: privacy compliance is becoming an ongoing operational process, not a one-time legal exercise.
Organizations should be reviewing their data inventories, vendor relationships, privacy workflows, AI use cases, and compliance documentation. Find out how Concord can help: concord.tech/

Australia may be raising the bar for how companies use personal data.
Proposed privacy reforms would introduce a new “fair and reasonable” test, requiring organizations to look beyond whether a data use is technically permitted and consider whether it is actually justified.
The reforms also strengthen privacy protections around data brokers, automated decision-making, sensitive information, and targeted advertising.
The bigger question for companies: Can you clearly explain why you are collecting and using someone’s data?
As privacy regulation evolves, knowing what data you have and how it is being used is becoming critical.

China is taking a more streamlined approach to privacy compliance for smaller organizations.
Starting September 1, 2026, new rules will apply to organizations that handle personal information on a smaller scale, with simplified requirements in areas such as privacy notices, consent, impact assessments, audits, and security management.

The CCPA is changing what it means to demonstrate privacy compliance. California’s finalized CCPA regulations introduce new requirements for certain businesses to conduct privacy risk assessments and, for qualifying businesses, annual cybersecurity audits The regulations took effect January 1, 2026.
Organizations subject to the requirements need to evaluate whether their processing of personal information creates significant risks to consumers and assess the safeguards they have in place to mitigate those risks.
That means privacy compliance increasingly requires more than policies and documentation. Teams need to be able to answer questions like:
• What personal information are we processing?
• Why are we processing it?
• Which processing activities create meaningful risk?
• What safeguards and controls address those risks?
• How are those risks documented and managed over time?
• Can we demonstrate that our privacy program is actually operating as intended?
The timing matters, too. Businesses subject to the risk assessment requirements must begin compliance in 2026, with information from 2026 and 2027 risk assessments due to the CPPA beginning April 1, 2028.
Cybersecurity audits are a separate requirement with a phased compliance schedule. Businesses that fall within the audit requirements will begin submitting certifications in 2028, 2029, or 2030 depending on annual gross revenue.
The broader takeaway for privacy and compliance teams is clear: Privacy compliance is becoming an ongoing risk management discipline, not a once-a-year documentation exercise.
Organizations need the ability to connect their data inventory, processing activities, privacy risks, policies, controls, assessments, and evidence.
That is where privacy automation can make a difference.
Concord helps organizations operationalize privacy and compliance by bringing data mapping, privacy workflows, policy management, risk management, controls, and audit-ready reporting together in one platform. concord.tech/

California’s 1967 wiretapping law is now at the center of nearly 4,000 lawsuits involving modern website tracking.
Meta Pixel. Google Analytics. Session replay. Chat tools.
The issue? If these technologies send visitor data to third parties before consent is given, they could create CIPA exposure.
With courts reaching different conclusions and more than 800 CIPA claims filed in 2025 alone, this is becoming a privacy, legal, and technical issue that organizations can’t afford to overlook.
We break down the latest case law, which tracking technologies carry the most risk, and what privacy teams can do to reduce exposure.

Vermont’s new data privacy and online surveillance law takes effect January 1, 2028.
The Vermont Data Privacy Act reaches into areas like sensitive data, universal opt-outs, profiling, data protection assessments, third-party data sales, and even disclosures around using personal data to train AI models.
The bigger challenge for privacy teams is operationalizing these requirements across systems, teams, and processes.

Concord Blog : How to Build the Business Case for Trust Center Software
What does your security review process actually cost your business? The answer is probably more than the hours your security team spends filling out questionnaires.
Manual trust workflows can mean:
→ Hundreds of hours spent answering repetitive questions
→ Deals sitting in security review for days or weeks
→ Teams searching across disconnected systems for the latest documentation
But there’s another way to look at Trust Center software: not as another security tool, but as a business investment.
Our latest article breaks down how to build the business case using three measurable outcomes:
• Lower operational costs
• Faster deal cycles
• Greater capacity without proportional headcount growth
The real question is: how much is your current trust process costing you?

While much of the privacy conversation has centered on AI regulation, New Jersey just enacted one of the most consequential state data broker laws to date.
A few provisions stand out:
🔹 The law applies not only to traditional data brokers, but also to organizations that collect personal data directly from consumers and then sell that information to data brokers.
🔹 It introduces annual registration fees that scale with company size, reaching up to $1.5 million for the largest organizations.
🔹 The sale of sensitive personal information—including health, biometric, genetic, financial, and precise geolocation data—is prohibited, with penalties of up to $50,000 per record for violations.
🔹 A public registry of covered organizations will be created, increasing transparency and regulatory visibility.
Privacy compliance is becoming more about having the operational visibility to know:
✔️ What personal data you collect
✔️ Where it flows across your organization
✔️ Who it's shared or sold to
✔️ Whether your policies and data practices align with evolving state requirements
As more states introduce specialized privacy laws targeting specific business practices, maintaining accurate data inventories, governance processes, and documentation becomes increasingly important.
