On the arrest of Young Bob, an analysis: In the passing week I have seen a variety of people poking fun at the footage of Young Bob (@YoungBobRB)'s arrest; calling his actions careless. I disagree, and his carelessness boils down to Bob failing to chill his own speech and expression on a subject completely. The reality of that arrest, and reasons for it, are laid bare in this compilation of footage – footage which demonstrates precisely how minority and activist groups can create criminal liability for those civilly engaging. Police will typically oblige in this regard. So-called slurs, including “The P Word”, are not illegal in Britain outright, as is often thought to be the case by citizens. When they do engage criminal interest, they form part of wider offences relating to public order or verbal assault (common law assault); the relevant thresholds include threatening or abusive words likely to cause harassment, alarm or distress under s.5 Public Order Act 1986, or intentionally causing such harassment, alarm or distress through threatening, abusive or insulting words under s.4A. Assault through words alone requires intentionally or recklessly causing someone to apprehend immediate unlawful violence. Simply saying, or indeed claiming the word/slur was said, does not establish any of these requirements. Police, increasingly censorial on issues relating to the interactions between Britain's fractured demographics, often prefer to arrest anyway in these instances. It is hard to determine what the stated reason for this arrest was due to the delighted screeching of the crowd around him, happy that police will enforce and criminalise words they have deemed politically inappropriate. From what I can tell here, it appears the officer states the arrest is occurring for "racially aggravated assault". Once one of these offences is made out (assault or a public order offence), it can then be “aggravated” by racial or religious hostility under the Crime and Disorder Act 1998, which is the source of what many describe as “hate crimes”. Section 28 defines the aggravation; ss.29 and 31 provide the aggravation to assault and public order offences. Another example where "racial aggravation" to an expressive offence came to pass was Hamit Coskun’s prosecution for burning a Quran. The CPS proceeded with the prosecution in this manner, prosecuting an alleged POA 1986 offence aggravated under s.31(1)(c). His conviction was subsequently overturned because the underlying offence had not been established, and that acquittal was upheld in DPP v Coskun [2026] EWHC 427 (Admin). Bob’s arrest appears wrongful given the footage immediately prior to it. It occurred largely on the on-the-spot evidence of the activist filming (in clip 1) who would, no doubt, like to see people engaging in the manner Bob has here removed from the discussion, and society, permanently. The police should explain what offence they reasonably suspected and why arrest was necessary under s.24 PACE 1984 – it is unclear if Bob heard given the expletives about his mother being shouted at him at the time of arrest (by the cameraman in clip 1). Britain is not a free country, and an array of laws must be repealed to allow it to reclaim that title, and prevent the police becoming mere enforcers amid a situation of mob rule (as here).
