This is one of the most important ballot initiatives anywhere in the country.

Neera Tanden: "What could possibly be protected speech if not facts developed from evidence and crime statistics about governmental policies? It's hard to imagine what the First Amendment would protect if it doesn't protect speech like that."

For decades, the influence of corporate money in politics has distorted American democracy and undermined public trust in government.
CAP's Corporate Power Reset offers a new path forward: Rather than continuing to fight the legal legacy of Citizens United on its own terms, states can redefine the powers they grant corporations in the first place, making unlimited corporate political spending functionally irrelevant. ampr.gs/4clbhoU
Just so we're clear: You have written that states have the authority to decide which powers to issue to the domestic and foreign entities operating as corporations within their borders. Do you still stand by that?

The position you’re taking makes no sense. Logically, what would stop the government from prohibiting newspapers from running editorials or opinion pieces supporting or opposing candidates for office, so long as the newspapers were owned by corporations? Doubtless you’ll say money isn’t speech, but that’s just silly. The NY Times spends money to print editorials.
Have you read these laws you’re criticizing? They have media-activity exemptions that mirror the federal language.
And you’re one of the last people I would expect to keep making the error that not empowering a corporation is the same as prohibiting it from doing something.

Oh, and as for what Montana does within its borders, I care quite a bit, as do most Montanans.
There’s no finessing on that point. There’s never been any claim that any of these laws affect anything outside the borders of the states that pass them. One by one, states will clean up their own politics of all dark and corporate money.
Taking a break from my x.com exile to spotlight my latest Substack post, which shows how UCLA Law's Stephen Bainbridge (@PrawfBainbridge) confirms the corporate-law underpinnings of CAP's Citizens-United-undoing Corporate Power Reset: open.substack.com/pub/corpor…
I’ll make a rare posting here to point this out: “Citizens United” is not a magic phrase you can just wave around and get the result you want. You need to see what the decision actually says and what its limits are. You’ll be surprised. See you all in court.
This legislation is unconstitutional, ignores the Citizens United decision, and it’s a violation of the First Amendment. Restricting political speech is a slippery slope and it must be confronted. the Citizens United opinion was crystal clear: ‘political speech does not lose First Amendment protection simply because its source is a corporation.’"

The @FEC's death by decapitation is part of this Administration's broader attack on fair elections and checks on corruption. My piece in The @guardian:

Trump has launched a brand-new assault on the rule of law: Trying to illegally fire the Chair of the Federal Election Commission (@FEC).
Chair Ellen Weintraub (@ellenlweintraub) must be kept on the payroll and on the computer systems, her access to FEC HQ unimpeded. The FEC general counsel needs to do her job and enforce the Federal Election Campaign Act. She does NOT need a vote of the Commission to do so.
Trump is purporting to fire Chair Weintraub in direct violation of federal law: 52 USC § 30106 (a)(2)(B): "A member of the Commission may serve on the Commission after the expiration of his or her term until his or her successor has taken office as a member of the Commission."

IT IS TIME TO ACT. Tell FEC general counsel Lisa Stevenson ([email protected]) that she MUST enforce the law and ignore this illegal act.

The Virginia House of Delegates just voted to ratify the Equal Rights Amendment as the 28th Amendment to the Constitution of United States of America.
“Equal rights under the law shall not be denied or abridged by the United States or any State on account of sex.”
