Whenever a any Group Housing Society have to call for a General Body Meeting (#GBM) or Annual General Meeting (#AGM) is conducted, the required quorum is often not achieved, resulting in adjournment. The #quorum requirement then gradually reduces from 40% to 25% and eventually to 15%. In many instances, even achieving this reduced 15% quorum becomes difficult. This is because only the person in whose name the flat is registered is eligible to become a member, and the presence of that particular individual alone is counted towards the quorum. If any other family member attends the meeting on behalf of the owner, such attendance is not considered for quorum purposes. In such circumstances, even if a decision is taken in the larger interest of the society, any other member of the society (even one who did not attend the meeting) can later file a complaint citing non-fulfilment of quorum requirements. Unfortunately, orders are sometimes passed on such complaints without a complete understanding of the facts, and in some cases, higher authorities sitting in Chandigarh issue directions without fully appreciating the provisions of the Act or the ground realities. As a result, the entire society suffers, disputes escalate, and people are sometimes compelled to adopt improper practices merely to ensure compliance. These are some of the reasons why societies are often reluctant to enroll more members. Under the HRRS Act, 2012, there is no mandatory provision requiring members to participate in AGMs or GBMs. While the Act prescribes quorum requirements, these provisions are frequently misused. The Government should take cognizance of such issues.
