A few months ago Thomas777 pointed out how absolutely ridiculous the post-WW2 standard of expecting soldiers to disobey "illegal" orders is. Throughout most of history, soldiers disobeying orders would be killed on the spot. And now they're just punished (sometimes severely.) The idea that a lowly soldier with no eye towards the strategic or the political is responsible for deciding which orders to follow and which to disobey is so obviously preposterous that it becomes a transparent justification to punish enemy military's en masse simply for losing a war.
