Charter rights are subject to reasonable limits justifiable in a free and democratic society. Does that mean that by invoking the Notwithstanding Clause/overriding Charter rights, a govt admits its law is not justifiable in a free and democratic society? Asking for some friends.
Beyond his remarkable work as a jurist, Strathy CJO’s leadership in making our profession more welcoming to different backgrounds and abilities has been inspiring. He has spoken out and stood up for a healthier, more diverse profession. Best wishes in whatever comes next.
