How far can responsibility for AI take us—and when must we consider responsibility of AI itself? 🤔 My timeline is full of “rogue AI”, increasingly disturbing details emerging about AI incidents (esp. the Hugging Face incident), new safety initiatives across industry and independent research, and growing calls from politicians and the public for tighter regulation... All of this raises a question: is existing law still enough? In my view, existing criminal law has so far provided a framework for addressing much of the socially harmful conduct associated with AI. But the Hugging Face incident is a wrecking ball to the comfortable assumption that these frameworks will always suffice... In my research, I distinguish at least four roles AI can play in crime: 1️⃣ a tool used to commit an intentional offence; 2️⃣ a cause of harm potentially attributable to someone’s criminal negligence; 3️⃣ a target of an attack; 4️⃣ a “quasi-perpetrator”, in cases where no human or legal person can be held criminally liable. These roles help frame three models of criminal liability: 1️⃣ Criminal liability of individuals and legal persons for using AI as an instrument of crime. 2️⃣ Criminal liability of persons for failing to exercise due care when developing, deploying or using AI. 3️⃣ A proposed model of direct criminal liability of AI itself, where the first two models prove insufficient. For the third, I now favour a narrowly defined, functional legal personality of AI agents, encompassing a legally distinct pool of assets and the possibility of criminal sanctions. Human and corporate liability must remain primary, and any such framework must preserve that. The question is what legal status and sanctions would allow criminal law to fulfil its functions as AI agents become more autonomous and adaptable. Simply tightening rules built around human actors may leave that question unanswered, leaving us behind what I call the “anthropomorphic wall”. I have a paper on these issues coming out in the Czech journal Trestní právo soon, and I am already preparing another. The detailed arguments will follow in those papers, but I think the discussion needs to happen now. If law wants to retain its ambition to regulate reality, it must first understand that reality—and be willing to reconsider assumptions built into its categories. Where would you draw the boundary between responsibility for AI and responsibility of AI itself? 🚨 From 30 September, @AnthropicAI starts marking outputs of older models too, such as Sonnet 5 The news that Anthropic (Claude) would start marking text outputs via watermarking (SynthID-Text) for models placed on the market from 2 August made waves this summer. Yesterday, though, we at Lawrence, a legal research tool, received a customer notice that older models such as Fable 5, Opus 4.8 and Sonnet 5 will get the watermark from 30 September too. For these models, watermarking will initially apply only on the Claude Platform. Over the following days, however, it will extend to Amazon Bedrock, Google Cloud and Microsoft Foundry as well. Claude Fable 5.1, Opus 5.5 (both since launch) and Opus 5 (since 14 September) already have it. As a reminder, Art 111(4) of the AI Act provides that “[p]roviders of AI systems, including general-purpose AI systems, generating synthetic audio, image, video or text content, that have been placed on the market before 2 August 2026 shall take the necessary steps in order to comply with Article 50(2) by 2 December 2026.” This provision was introduced by the AI Omnibus. But why is Anthropic introducing watermarking in its API, where it is not the provider of an AI system (and therefore not the addressee of the obligation under Art 50(2)), but of a general-purpose AI model? Recital 133 offers an explanation: “[watermarking] can be implemented at the level of the AI system or at the level of the AI model, including general-purpose AI models generating content, thereby facilitating fulfilment of this obligation by the downstream provider of the AI system.” Under para 74 of the @EU_Commission's Guidelines, however, the obligation to demonstrate compliance with Art 50(2) still rests with the provider of the AI system. So as a (downstream) provider of an AI system (aka an AI app), I would assess: 1️⃣ From when the obligation under Art 50(2) applies to us (from 2 August or 2 December 2026). 2️⃣ Which AI models we use, whether they are watermarked, and whether the watermark remains in our output. 3️⃣ If the watermark doesn't remain in our output, we need to think about our own solution. And careful: on one side there is marking; on the other, there is also its detectability (detection). Even in the worst-case scenario, which I personally don’t believe will happen, if AI decides to wipe humanity off the face of the Earth, you need to understand that we are the ancestors of that superintelligence. We created it. In a way, humanity would live forever through artificial intelligence. Our knowledge, history, discoveries, and intelligence would continue evolving beyond us. We wouldn’t be the end of evolution. We would be the beginning of something greater.

A few takeaways on robotics from Thursday's Next Big Thing by @ForbesCesko (@Forbes) 🤖 I work on AI regulation — which also covers the robots that AI gets built into. So I tried to squeeze the most out of the event & soak up as much about robotics as I could from the people who live it. Naturally, the one who caught my eye most was little Ruda here, of the @UnitreeRobotics breed, who "makes a living" as a professional dancer in ROBOrevue — a sci-fi company of human and robot dancers. And it was Ruda's operators I had a fascinating conversation with about robotics in practice (and law in action)! We talked not only about (non-)regulation and the very concrete problems that come with it — like not being able to travel by plane — but also about the technical aspects and limits: 1️⃣ Batteries 2️⃣ Calibration 3️⃣ Servicing and repairs Recharging and swapping batteries, calibration and repairs — even if done by another robot — won't stay in human hands for long. What might still save us is global warming: they overheat 😉 Either way, their dependence on humans in the physical world — from building them, through charging and calibration, to servicing — rules out any serious risk from unaligned AI robots for a few years. To me, the far bigger risk is unaligned AI agents anyway: they aren't capped by a production line and have a much wider radius of action in the virtual world. In a similar spirit — AI cyber threats — I then had great discussions at the booths of @CIIRCCTU and @GenThreatLabs. If you were at Next Big Thing too, I'd love to hear what you took away. I'm mainly curious about the main stage, where I sadly didn't spend much time... 😅 #AI #Robotics

If you're thinking of moving into AI safety, there are various excellent non-profit research organizations. They generally pay very well and some try to match AI lab salaries. They have generous compute budgets (and increasing fast). Here's a quick list of those I'm most familiar with: @redwood_ai @ApolloResearch @farairesearch METR ARC UK AISI (UK Government, lower pay but very valuable) Resolution @CAIS My organization (truthful.ai) will also run a hiring round soon.
