This Supreme Court hearing is getting weirder.
The question is: can you sue websites for sharing your data under the law that Congress passed in the 1980s to ban the sharing of a customer's video rental history?
The law was passed after the Washington City Paper published then SCOTUS nominee Robert Bork's video rental history, revealing anglophilic tastes and an appreciation of Cary Grant.
Justice Kagan imagines a hypothetical judge who's online video history is leaked, revealing an embarrassing fascination with women's wrestling.

Accepting a Philadelphia Bar Association award named after Justice Brennan, Justice Ketanji Brown Jackson said dissents are an "expression of faith in the future and a demonstration of hope" in a prerecorded video message.
Jackson, Biden's lone appointee, is the most frequent dissenter on the Supreme Court. Link to Law dot com story below. #SCOTUS

NEW: The Trump administration is asking the Supreme Court to bless the practice of hand-picking new acting U.S. attorneys before a permanent nominee is confirmed by the Senate.
Three federal appeals courts have found the practice violates the Federal Vacancies Reform Act. The dispute could affect as many as 14 judicial districts around the country, and potentially other federal offices requiring Senate confirmation.

BREAKING: Supreme Court rules 5-4 that construction may continue on Trump's White House ballroom project. Chief Justice Roberts, who earlier voted to temporarily allow construction to continue, has now authored a dissent joined by the liberal justices. The construction, he says, is "likely unlawful."
"Today’s decision is no victory for the separation of powers," Roberts writes.

Monday's SCOTUS order greenlighting Trump's mail voting overhaul was the latest sign of division between the court's three liberal justices over what a dissent should look like.
Where Justice Jackson lambasts the majority for the "disservice" of making election law a "Kafkaesque nightmare," Sotomayor, joined by Kagan, emphasized the narrowness of the ruling and registered her disagreement in rather mild terms.
It's not the first time Jackson has chosen rhetorical bombs over Sotomayor or Kagan's more diplomatic approach. Of course, Sotomayor and Kagan aren't afraid to dish it when they want to either.
Could tenure be playing a role here? Sotomayor is approaching her 20th year on the court and has described her colleagues as a "family." Jackson is only in her 5th year and could see an influx of new justices in the not too distant future.

NEWS: The Trump administration is asking the Supreme Court to uphold the president's shutdown of asylum claims at the Mexico border, calling it the "cornerstone" of his immigration policy.
A D.C. Circuit decision declaring the asylum shutdown unlawful threatens to "upend the Administration's single most effective policy in resolving a border crisis that had undermined our Nation's sovereignty," the solicitor general said in a Monday petition.
To my mind, the court seems highly likely to take the case and rule on the legality of the shutdown by end of June 2027.
The Supreme Court in June upheld the government's authority to "turn back" asylum claimants during immigration surges. This case asks whether the president can effectively end asylum along the border entirely by proclamation. Link to my story on Law dot com below.

The shadowiest part of the Shadow Docket?
@steve_vladeck writes about the lack of, well, writing about "administrative stays," the obscure procedural tool used by Chief Justice Roberts to unilaterally allow construction to continue on Trump's White House ballroom.

The Supreme Court has taken a legal buzzsaw to the power and autonomy of federal agencies in recent years. For @TheNLJ, I look at the next potential target of the conservative justices' constitutional project: reining in an already dysfunctional Congress.

Justice Kagan tells House panel that she's no longer as mad about the Supreme Court's emergency docket these days.
"I think that as we've gotten more experienced in these constant requests that are coming to us... that we better recognize that at least sometimes there is a need for additional information, and we have issued opinions, and sometimes majority and dissenting opinions accordingly," she testified. #SCOTUS
