BitMart's case is so complex and messed up that it feels like a mix of @CelsiusNetwork and @MtGox, only this time repackaged under an opaque "restructuring" that blurs user property rights into unsecured claims.
Already 18 days since the last announcement, and we still lack clarity from Alvarez & Marsal, the Exchange, and their legal counsel (White Case) regarding the court process.
Had a tough convo with clients and friends stuck there, cause expectations for their proposed plan are low. A positive outcome for the upfront recovery (Option 1) would be imo in the 50-70% range; realistically, it could be much lower given the lack of accountability.

⚠️ BitMart 用户必须警惕：如果我们的资产最终被当作普通债权处理，可能面临的损失远比想象中严重！
我希望所有 BitMart 受害者都认真思考一个问题：
我们存在 BitMart 的加密资产，究竟是属于我们自己的财产，还是已经变成了 BitMart 欠我们的一笔债？
这不是简单的文字游戏，而是可能直接影响最终资产追回金额的重大法律问题。
根据 BitMart 官方《用户协议》第2.7.1条，对于协议涵盖的相关数字资产，BitMart 曾明确约定：
“数字资产的所有权始终归属于用户，不会转移给 BitMart。”
但如今，在 BitMart 公布的重组方案中，我们看到的却是债权人、债权分配、账户资产折算为美元等安排。
问题来了：如果相关资产的所有权本来就属于用户，为什么现在要按照公司的债务来讨论如何返还？
⚠️ 所有权与普通债权，可能决定我们能不能拿回原本属于自己的资产。
如果用户能够依法证明对相关资产享有所有权，就可能有机会要求返还资产，而不是与普通债权人一起参与剩余财产分配。
但如果最终只能作为普通无担保债权人，我们将可能面临另一种局面：
假设 BitMart 最终被认定为资不抵债，在支付相关程序费用、优先债务等之后，究竟还能剩下多少资产分配给普通债权人？
可能是50%，可能是10%，也可能更少。
最值得警惕的情况是：我们原本可能有权要求返还的资产，最终却只能按照普通债权获得很少一部分赔偿。
当然，这不意味着所有用户都必然享有可以直接追回资产的所有权。不同资产和理财产品可能适用不同协议，最终仍需由法律程序认定。
但正因为如此，我们才更不能在没有充分审查法律权利之前，就轻易接受 BitMart 单方面提出的处理安排。
⚖️ 这也是为什么我们决定聘请专业律师，正式启动法律行动。
目前，我们已经与段和段律师事务所签约，三位受害者代表共同承担并支付了第一期5万美元律师启动资金。
我们的核心目标之一，就是通过法律途径，尽最大努力争取用户可能享有的资产所有权，而不是被动等待 BitMart 决定返还多少。
请大家明白：聘请律师不能保证追回资产，但放弃了解和主张自己的法律权利，也可能让我们失去争取更好结果的机会。
我们已经等了两个多月。
如果未来重组程序继续推进，而我们始终没有认真审查自身的财产权利，等到资产处置和分配方案逐渐确定，再想改变局面，可能会变得更加困难。
我们不能保证最终胜利，但至少不能在没有充分争取之前，就默认接受最不利于自己的法律地位。

希望更多人认真了解所有权与债权的区别，尽早考虑适合自己的法律维权方案。

And all of this could have been avoided if one man had simply chosen to do the right thing and return people's money instead of risking criminal prosecution over funds that belong to users.

The CLARITY Act didn't advance in the Senate today, which was a disappointment. While it's possible bi-partisan conversations continue and it lives to fight another day, we can't wait on Congress anymore.
The SEC and CFTC have the tools they need to create clear rules under existing authority, and I expect will begin working on this in earnest.
So clarity is coming to crypto regardless.
And of course GENIUS is already the law of the land for stablecoins, which is even more permissive on rewards. There were some concessions we made on CLARITY that were tough to swallow, so perhaps it's for the best.
Crypto can't be uninvented. With clarity emerging through the regulators, we'll continue updating the financial system.
