Important information on one of the two legal battles led by BULLBITCOIN.COM in its fight against DAC8 and the mass surveillance of cryptoasset users.
You all know that BULLBITCOIN.COM initiated a legal challenge against the Council of State in February 2026 to contest the application of DAC8 in France. This announcement was made in June 2026 at the BTCPrague conference, and the details of the challenge are available on DAC8.COM
What you didn't know is that we had also initiated a second challenge in August 2026. This challenge requested the immediate suspension of the decree implementing DAC8 in France.
It is important to understand that this challenge, a summary suspension proceeding, is different from the first challenge contesting the very legality of the decree.
It was about requesting the emergency suspension of the DAC8 decree in question pending a ruling on the merits, on the grounds that its application could cause irreparable harm. We clearly and unequivocally demonstrated that the implementation of DAC8 in France would pose a real and imminent danger to the security of crypto holders and their loved ones, and that there therefore exists a situation of urgency and serious harm justifying the immediate suspension of the decree.
The concentration of data, including the physical addresses and the amount of crypto transaction data of users, in a database shared with all the tax authorities of the EU member states, represents a significant risk of leakage with disastrous consequences such as their exploitation by criminals to kidnap, mutilate, and extort holders or their loved ones.
We regret to announce to you today that this summary suspension proceeding has been rejected by the Council of State.
However, this refusal in no way means that the Council of State rejects our substantive arguments, and concerns only the grounds of urgency. Moreover, the absence of comment on the substantive arguments leads us to presume that the Council of State considers our approach to be well-founded.
Our legal proceedings for the complete annulment of the DAC8 decree is still ongoing, and we are very confident of winning it.
Nevertheless, we are dismayed by the Council of State's response, which can be summed up as follows:
“The applicant companies [Bull Bitcoin and Paymium] also fail to establish how the storage of this data within a register centralizing all transaction data of all residents of EU member states would be likely to heighten the risk that it be compromised, especially since, in any event, the mere possibility of a risk, the probability of which is very low, cannot constitute a situation of urgency."
Yet, the DGFIP (French tax authorities) itself declared, in February 2026, during parliamentary discussions on the creation of a crypto-asset portfolio declaration, that “a generalized declaration of these [crypto-asset] portfolios would lead to the centralization of highly sensitive data, such as the identity of holders and the value of their assets” and that “in a context of frequent cyberattacks against large databases, this information would become a prime target for hackers, with risks of fraud.”
Our demonstration of urgency is supported by the facts, by French and international expertise, and by common sense. Violent crimes targeting crypto holders and their loved ones, as well as data leaks held by government institutions that make them possible in the first place, are becoming increasingly serious and frequent. You only need to read the news in France to reach the same conclusion.
In the coming days, we will publish the details of our summary proceeding, including supporting documents and arguments, so that you can judge for yourself the merits and factual basis of our demonstration.
We are waging this war against mass surveillance on multiple fronts and in multiple countries. We have won battles and suffered setbacks. This minor defeat only strengthens our determination.

Vous savez tous que BULLBITCOIN.COM a entamé un recours judiciaire contre le Conseil d'État en Février 2026 afin de contester l’application de DAC8 en France. Cette annonce a été faite en Juin 2026 lors de la conférence BTCPrague et les détails du recours sont disponibles sur DAC8.COM
Ce que vous ne saviez pas, c’est que nous avions aussi entamé un deuxième recours en Août 2026. Ce recours demandait une suspension immédiate du décret qui implémente DAC8 en France.
Il est important de comprendre que ce recours, un référé en suspension, est différent du premier recours contestant la légalité même du décret.
Il s’agissait de demander la suspension en urgence du décret DAC8 en question dans l’attente d’un jugement sur le fond, au motif que son application pourrait causer des dommages irréparables. Nous avons ainsi démontré de manière claire et sans équivoque que l'implémentation de DAC8 en France constituerait un danger réel et imminent à la sécurité des détenteurs de crypto et de leurs proches et qu’il existe, par conséquent, une situation d'urgence et d’atteinte grave justifiant la suspension immédiate du décret.
La concentration des données, notamment les adresses physiques et le montant des transactions crypto des utilisateurs, dans une base partagée à l’ensemble des services fiscaux des Etats membres de l’UE, représente un risque significatif de fuite avec des conséquences désastreuses telles que leur exploitation par des criminels afin de séquestrer, mutiler et extorquer des détenteurs ou leurs proches.
Nous avons aujourd’hui le regret de vous annoncer que ce référé en suspension a été refusé par le Conseil d’État.
Cependant, ce refus ne signifie en aucun cas que le Conseil d’Etat rejette nos arguments sur le fond, et concerne uniquement le motif d’urgence. De plus, l’absence de commentaire sur les arguments de fond nous laisse présager que le Conseil d’Etat considère notre démarche comme fondée.
Notre recours pour l'annulation complète du décret DAC8 est toujours en cours et nous sommes très confiants de l'emporter.
Nous sommes néanmoins consternés par la réponse du Conseil d'État, qui se résume ainsi:
“Les sociétés requérantes [Bull Bitcoin et Paymium] n’établissent pas non plus en quoi la conservation de ces données au sein d’un registre centralisant l’ensemble des données de transactions de tous les résidents d’Etats membres de l’Union serait de nature à accentuer le risque qu’elles soient compromises, alors au demeurant que la simple éventualité d’un risque, dont la probabilité de réalisation est très faible, ne saurait être constitutive d’une situation d’urgence."
Pourtant, la DGFIP (services fiscaux français) a elle-même déclaré, en février 2026, dans le cadre des discussions parlementaires relatives à la création d'une déclaration des portefeuilles de crypto-actifs, qu' « une déclaration généralisée de ces portefeuilles [de crypto-actifs| conduirait à centraliser des données très sensibles, comme l'identité des détenteurs et la valeur de leurs actifs » et que « dans un contexte de cyberattaques fréquentes contre les grandes bases de données, ces informations deviendraient une cible privilégiée pour les pirates, avec des risques d'escroquerie »
Aussi, nous maintenons que notre démonstration sur l’urgence est supportée par les faits, par l’expertise française et internationale, et par le bon sens. Les crimes violents ciblant les détenteurs de crypto et leurs proches, ainsi que les fuites de données détenues par des institutions gouvernementales qui les rendent possible en premier lieu, se font de plus en plus graves et fréquents. Il suffit de lire les nouvelles en France pour en arriver au même constat.

The French tax authority has been hacked again. The records of hundreds of thousands of citizens (including their income) is now potentially in the hands of criminal groups.
That same agency wants to force crypto companies to hand them our user's data.

No user funds are at risk because both Boltz and BULL are non-custodial by design.

BULL is immediately shifting our priorities to resume the ability of BULL wallet users send receive Bitcoin payments over Lightning, as well as move funds between Liquid and Bitcoin. We are evaluating multiple options and are beginning the work right now.
Ae have been in constant contact with our very good friends at Boltz for years. We have been, and are right now, collaborating closely with their team. They are my brothers in arms and I fully support their decision to suspend their service.
Let me be clear: Bull Bitcoin is a member of the Liquid federation and can convert LBTC to BTC without a 3rs party. No BULL wallet user will have funds "stuck" on Liquid, that I can guarantee.
Our immediate action plans are all targeting the same goal: BULL wallet users will carry on sending and receiving Lightning payments and perform swaps between Liquid and Bitcoin. The only question are implementation details. We will figure it out.
Until a solution is implemented, Lightning payments and Liquid <> Bitcoin swaps in the wallet will be fail without explanation.
I will not let this situation linger. I will fix it, no matter what it takes. I will be buying my grocies with Lightning over the BULL wallet as soon as possible.
I won't lie to you, the situation seems pretty bleak. First, the Coldcard exploit. Now, a critical piece of Lightning infrastructure goes offline. We are undoubtedly on the losing end of the Token War. Attackers have been scoring major victories.
We are going to fight back. We will never surrender. I apologize for not giving more details. I have work to do.
Update: Boltz will stay disabled until further notice.
Our API remains available to process refunds cooperatively. In any case, unilateral refunds will work, as they do not depend on our infrastructure.
Our support team stays reachable.
To be clear: this is not a response to a single incident. Over the past months we have seen a steady rise in automated, AI-assisted probing of our infrastructure, and we have dealt with several exploits. Each was contained, but the pattern is clear: attackers now iterate faster than a team our size can find and patch. In the past few days alone we saw a drastic acceleration, and we do not believe this asymmetry will reverse. After reviewing the results of our own recent security scans, we cannot responsibly re-enable Boltz swaps, especially as we are being actively targeted by what appear to be multiple resourceful groups while we race to deploy fixes.
What we are seeing is a major paradigm shift for Bitcoin services operating on an open source stack, and it needs careful analysis. Do not expect swap services to resume shortly.
To be explicit: no user funds were ever at risk. Boltz is non-custodial by design. And as a fully bootstrapped company, the losses were ours alone.
We don't know yet how things will continue from here, but we'll keep you posted as soon as we have had the time to catch our breath and make a decision 🙏

An acquaintance of mine intentionally left a small amount of bitcoin in a ColdCard MK4 RNG created seed phrase (that was originally a "duress" wallet) to see when it might get swept. Last night it got swept to bc1qzm5pauxyv7t7vqstzpumqcn066wfjsmev34mf3.
So at this point any RNG generated seedphrase on any ColdCard product is under active attack. Move quickly if you're exposed.
