We've updated our analysis of the Biden DOJ's third party-payment policy to include a 2020 memo (acquired via FOIA) in which the Trump DOJ’s Office of Legal Counsel affirmed that "certain payments to third parties" are allowed under the Misc. Receipts Act. eelp.law.harvard.edu/2022/06…
Many thanks to @ByTomFrank for reporting on Census numbers suggesting "unbelievable" rates of disaster displacement in the US. While data are "experimental", they illustrate for @FEMA, state govts who is most vulnerable to the impacts of disasters.
"These numbers are unbelievable," says @hperls of Census figures showing disasters forced 3.4m people in US from home in 2022.
That's far higher than other estimates and shows “international data and reporting severely underestimate the number of IDPs."

First: I’m pardoning all prior federal offenses of simple marijuana possession. There are thousands of people who were previously convicted of simple possession who may be denied employment, housing, or educational opportunities as a result. My pardon will remove this burden.

Yesterday, investor-owned utilities in PJM alleged that a comment I filed at FERC was “defamatory.” They don’t explain further.
Their overreaction highlights an odd dynamic that I see often in utility regulation.
A great thread from @Earthjustice's Marvin Brown on the practical realities of having homeowners switch over HVAC systems to #heatpumps. Thanks for sharing!!

A great🧵from @CLF @Staci__Rubin and @cpealesloan on what's good and what's missing on #EnvironmentalJustice in MA's new Clean Energy and Climate Plan
Last week, Massachusetts released its final Clean Energy and Climate Plan (CECP). @cpealesloan and I are diving in to explore components of the plan. Let’s look at climate justice and a just transition: A short thread. 1/10
Yes.

The case leaves open the door for EPA to regulate CO2 from power plants individually, just not sector-wide. But the decision is more important than that suggests because it signals much greater scrutiny of agency authority generally. Not just power plants and not just climate.
States are setting the example on #EJ, but #NY's new constitutional provision guaranteeing clean water, clean air and a healthful environment may be weakend in court. A crucial take from @bratspies and @ProfKTQ in @BLaw.

This past week has seen a repudiation of the court-based theory of change that has defined legal liberalism for several decades in the US: a theory that elite lawyers will always be able to use elite reasoning to persuade elite judges not to let things get out of hand.

I met an unhoused woman who has two years of disability payments sitting in a bank account she cannot access because she does not have an ID. After months we finally got her birth certificate and then she woke up to a sweep where all of her paperwork was thrown away.
CEQ also planning to issue a Notice by July on how fed. agencies should consider greenhouse gas emissions/climate change under NEPA 👀
