SAVE THE DATE! 📌 [Exclusive] Citizen Participation Trial Rejected… Kim Se-eui’s Defamation Trial Over Kim Soo-hyun to Resume on the 15th The trial of Kim Se-eui, head of Garosero Research Institute (Gaseyeon), who was indicted on charges of spreading false information about actor Kim Soo-hyun, will resume on the 15th. The Seoul Central District Court’s Criminal Division 26 will hold the second preparatory hearing for Kim Se-eui’s case on the 15th. He faces charges including violating the Information and Communications Network Act (defamation). The case was originally assigned to Criminal Division 14, a single-judge panel. However, following a decision to transfer it to a collegiate panel, it was reassigned to Criminal Division 26, where three judges preside. This procedure allows a case originally handled by a single judge to be heard by a three-judge panel based on the nature of the case. At the first preparatory hearing in September, Kim Se-eui’s lawyers maintained their request for a citizen participation trial. However, after the hearing, the court decided not to grant the request. Kim Soo-hyun’s lawyers asked the court to consider the circumstances surrounding the request. They said Kim Se-eui had publicly stated that he wanted a citizen participation trial because he needed to “fight against the enormous left-wing power,” and asked the court to consider whether such arguments were consistent with the purpose of a citizen participation trial. They also expressed concern that the defense might be attempting to bring the distorted atmosphere surrounding the case at its beginning back into the trial and potentially use the proceedings politically. The two sides also disputed the allegations themselves. Kim Se-eui’s lawyers argued that the statements at issue were not false, claiming that the late Kim Sae-ron had been in a relationship with Kim Soo-hyun since she was a minor. They cited a memo allegedly written before Kim Soo-hyun entered the military, KakaoTalk messages, and photos and videos allegedly taken at Kim Sae-ron’s home. Regarding the National Forensic Service’s analysis, they argued that the NFS had merely responded that it was difficult to determine whether the material involved deepfake/deep-voice manipulation based on the materials provided. They also claimed that Kim Sae-ron’s mother had confirmed that the voice in the recording was definitely her daughter’s.
