The Algorithm Is the New Courtroom 1/ David Sabatini just won $6M from a jury that found the misconduct allegations against him were defamatory. It took 5 years, his lab, and his career to get there. The process was the punishment. #healthcare #physicians

5/ There are hundreds of Sabatinis in medicine whose careers were ended by "professionalism" narratives built on illusory quality concerns. The immunity structure means we may never find them.

6/ Laws meant to protect patients now function as tools for hospital and insurance systems to control physicians. That's part of why your healthcare is unaffordable. What would a process that protects both look like?

Application: contactless remote patient monitoring.
breathing is enough to give you away each breath slightly changes how Wi-Fi waves reflect off your chest. with the right receiver and processing, those tiny changes can reveal your breathing rhythm the graphs in this animation use real WiRe-Breath recordings: orange is the rhythm extracted from Wi-Fi, gray is a reference breathing sensor i broke down how this works, and what else you can pull out of the radio waves around you, in the article below ↓

The hidden damages of presumption of guilt culture that pervade academia and medicine are more destructive than the damages the culture is there to prevent. While the culture rehabilitates the presumed victims, the most hidden victims such as David Sabatini whom the culture portrays as aggressors have no recourse.
A huge part of my story is @IOCBPrague, an inst. in a city I had never visited. They gave me a lab, Dir @konvalinka_jan defended me on TV, & the fearless Dr. Keckesova took arrows for me. IOCB launched @IOCBBoston with support from @BillAckman et al and bold lab members joined me

This is a deeply troubling case. We pray for Ms. Vasamsetty’s health and for a swift and fair determination of the merits of her case by the courts. We are also deeply concerned by the apparent disregard for her religious rights, particularly the cavalier dismissal of her religiously rooted aversion to consuming beef. At a time when our legal system appropriately accommodates the sincerely held religious beliefs of even those who have been convicted and incarcerated, it is unacceptable for a grandmother facing hotly disputed allegations to have her own faith treated with such disregard. Religious freedom is a bedrock principle of the U.S. Constitution and the American way of life. Ms. Vasamsetty has lived and worked legally in this country for decades, dedicating herself to serving disadvantaged students in the community she made her home. That she should now be treated in this manner by the very government and society she has served is deeply troubling. We urge elected officials and relevant authorities to ensure that her civil and religious rights are fully respected and to recognize this case as part of the broader concern over anti-Hindu bias in America. @SanfordBishop @RepMcCormick @RepSuhas msn.com/en-us/crime/general/…

I was hesitant & nervous. Will I be able to sing again? Can I hold my breath long enough to maintain the high tone and the length? Will my voice crack? This is the first song I sang after I had lost my voice. The great surgeon who operated on me:

7/ So why hasn't it happened? Not technology — LAW. In 2023 the antitrust agencies withdrew the 1996 safety zone that told physicians how to pool information legally. Remove the map and, for a co-op without a law firm, uncertainty = prohibition.

8/ The fix: a safe harbor written for creator-governed data collectives, and a de-identification switch conditioned to pay the collective back. And physicians are already organizing — union-petition filings up more than tenfold into 2023–24.

6/ COLLECTIVE LICENSING. When a café plays music it doesn't call 10,000 songwriters — it buys one blanket license from ASCAP, which pays the creators back. A century old. No reason a clinical-data collective couldn't work the same way. "Data as labor."

5/ A COOPERATIVE. Switzerland's MIDATA: a member-governed health-data cooperative, one member one vote, surplus reinvested. The corpus, held by the people who make it. The US attempts have struggled — which is an argument for support, not against the model.

2/ Clear the false cures first. Not banning the tools (they help). Not nostalgia (paper hid the capture; it didn't stop it). And not one lawsuit at a time — when a patient sued over de-identified records going to Google, the courts turned him away for lack of standing (Dinerstein, 7th Cir. 2023).

4/ PORTABILITY. Europe's GDPR gave individuals a right to carry their own data since 2018. The US has none — HIPAA gives a right to a copy, not portability. Florida's departing-physician release is the seed. That's the floor.

3/ The individual is the wrong unit. The answer has to be collective and structural. Three pieces: → a way to HOLD your own data → a way to POOL it under the creators' control → a way to LICENSE the pool so value returns Portability. A cooperative. A collecting society.

1/ Four essays, one wound: the people who make medicine's intelligence — physicians and patients — hold no claim on what it becomes. The last essay is about the other direction. A stake is buildable — from parts that already exist. journal.alignedphysicians.co…
