There’s already a bill—the Bivens Act—tailor-made to create a constitutional cause of action against federal officials and nothing more (or less). It adds 5 words to Section 1983. Congress should pass it.
One suggestion for legislation in a new Congress: A statutory Bivens remedy.

For the uninitiated: the suggestion is to pass a law allowing people to sue federal officers for violating their rights. Congress should absolutely do this.

And as incoming House FSGG chair, @RepMarkPocan is already on notice: Meeting with the justices in the Chief Justice's conference room each year to discuss SCOTUS' budget, as occurred 2020-25, won't cut it. Live hearings with the justices must once again become an annual event.
I’m very excited to have a Democratic majority in the next Congress. Serving on the Appropriations committee will be especially important as we can stop Trump from many of his worst actions by denying funding of those programs. I should chair a subcommittee that will have important jurisdiction over the White House budget and more, so my 14 years have brought me to a position I can impact things for the positive in a bigger way than ever. Thank you to everyone who helped get me to this point. I truly appreciate it!

JUST OUT: Reform outlook for 120th: fixthecourt.com/wp-content/u…: — Dems unlikely to spend major floor time on court bills given Trump veto — Don't ignore big ticket; spend time building case — Focus on bipartisan bills to demo governing ability (judgeships, PACER, workplace conduct)

Only the Judiciary Committee nerds will truly appreciate the fact that Scott Colom is only a Senate candidate because Cindy Hyde-Smith did not return a blue slip on his District Court nomination.

Why can't @uscourts issue the same memo? — Not hard — Easy win on accountability Or you don't want to do it because Fix the Court suggested it (back in May fixthecourt.com/2026/05/ftc-…)? Come on.
NEW: Skydance memo: “Employees who work for CNN, CBS News, or any other company news organization, including local television stations, are not allowed to place bets on prediction markets. When in doubt, don’t trade.” More: “Violations may result in disciplinary action up to and including termination and could carry personal civil or criminal penalties.”

In a vacuum, an emergency election-related request from the federal government is the sort of thing that SCOTUS typically would take very seriously. A terse, 9-0 order denying such a request, without even getting the other side's response, is the court's way of sending a message.

Unlike state supreme courts, the U.S. Supreme Court has no effective framework for holding its justices accountable for ethics violations. That needs to change, writes Gabe Roth of Fix the Court. brennancenter.org/our-work/a…

PACER reform, more USDC judgeships, workplace conduct reform: 3 things that aren't as sexy as term limits or court expansion but are incredibly important & eminently achievable. Whatever the results tmrw, we look forward to working with Ds & Rs on this & more in the 120th.

Following 4 recusals in single copyright petition last month, #SCOTUS must implement a new recusal policy. Read our letter to the Court on what we think should happen next: fixthecourt.com/2026/11/fix-….

Or will they restore order by instituting #SCOTUS term limits, bringing justices’ tenure back to historic average (18 yrs) vs. current 28 yrs & rising? And will they use power of the purse to affect change in Article III, which both parties did ~1789-1988 but have since stopped?
The single, overriding question of our politics is whether Democrats will shatter our constitutional order in 2029-30. All other questions are secondary.
