The Commission continues to champion access to justice and the protection of the rights of persons with disabilities through strategic legal representation and advocacy. Appearing on behalf of the Commission, Desire Njamwea represented the accused in Republic v. Kennedy Gachioki, where the court received both the Social Inquiry Report and the Psychiatrist Report. The reports confirmed that the accused has had an intellectual disability since birth, with the psychiatrist concluding that the condition is permanent, untreatable, and requires structured care and supervision rather than criminal prosecution. On the strength of these findings, the commission applied for the withdrawal of the charges, citing significant violations of the accused's constitutional right to a fair trial. The application highlighted the prolonged delay in determining the accused's fitness to stand trial despite multiple medical assessments and High Court directions, as well as procedural irregularities that undermined the administration of justice. The Office of the Director of Public Prosecutions (ODPP) requested time to seek directions on the application, and the matter is scheduled for mention on 16th September 2026. The Commission will continue advocating for justice processes that are fair, humane, and responsive to the needs of all Kenyans, particularly those from vulnerable and marginalized groups. #AccesstoJustice #EqualityInAction #KenyaLaw #DisabilityRights

When Deaf voices are left out of #ClimateAction the consequences are real. #ClimateJustice requires inclusive planning, and meaningful participation of Deaf people.
Too often, Deaf people are missing from climate conversations. Many discussions happen without Deaf Participation. #InclusiveClimateAction means Deaf people are present, heard, and involved in shaping solutions.

Climate change is not just an environmental issue. It is a justice issue. As heavy rains, and floods hit different parts of Kenya, we must ask ; Who is being protected? Who is being left behind? #ClimateJustice
