In September 2023, Leafly filed an Article 78 petition against OCM in Albany County state Supreme Court challenging a rule banning third-party advertising and marketing services in NY's AU market.
Leafly claimed that OCM illegally and unfairly targeted “third-party platforms” with regs that are unconstitutional bc they impermissibly restrict their right to free speech by preventing these companies from marketing & promoting AU products. The regs would have prohibited anyone from advertising on the Leafly platform or any other third-party platforms.
Although this case was originally aimed at specific marketing regs, the court today just ordered ALL(!) of the adult-use regulations unlawful & void as arbitrary and capricious. Will follow up with more analysis.
