QUICK HISTORY LESSON: Why most H-1B employers never have to certify that no American can do the job
The modern H-1B program was created by the Immigration Act of 1990. During drafting, proposals that would have required employers to actively recruit U.S. workers and attest they could not find a qualified American were considered… and then DELIBERATELY dropped from the final bill.
Congress instead created the Labor Condition Application (LCA), which mainly requires attestations on wages (the higher of the actual wage paid to similar employees or the prevailing wage) and that working conditions will not be adversely affected. No routine labor-market test proving U.S. worker unavailability for ordinary employers.
The extra rules that do require good-faith recruitment of Americans and non-displacement attestations apply only to “H-1B-dependent” employers (generally those whose workforce meets size-based thresholds, such as 15%+ H-1B for larger companies) or prior willful violators.
Those provisions were added in 1998 by the American Competitiveness and Workforce Improvement Act. Most large tech companies do not meet the dependency test.
The full “unable to find a qualified, willing, and available American” recruitment process has always been required for PERM (permanent labor certification for most employment-based green cards), not for standard H-1B petitions.

H-1B workers from some countries are indeed paid more than comparable Americans, but that isn't the case for most countries, including the main sources of H-1B workers, India and China.

WSJ: A Princeton PhD in chemical engineering applied to 2,300 jobs, ranging from postdoctoral fellowships to corporate science jobs and software engineering positions. He still hasn’t found a job. 34% of Americans surveyed by Gallup in August said it was a good time to find a quality job.
Meanwhile, Congress is fixated on finding a way to pass a bill that staples green cards to any international student who earns a PhD in the United States.
We should start by asking why our own graduates can’t find jobs before importing more workers.

Funny how US Imperialism rarely forces ppl to drop the metric system, spell colour without the u, say Zee instead of Zed, or adopt a wide variety of other cultural norms shared by 99.99% of Americans but instead it always seems to force ppl to adopt one specific group's culture

The only players in @NBAHistory with multiple months average 40+ PPG:
1. Wilt Chamberlain [11x]
2. Kobe Bryant [4x]
- END OF THE LIST -
Mind you Wilt was doing this when teams were averaging 118 PPG…
Kobe did it when teams were averaging 95 PPG 🤯

Microsoft has closed another way to set up Windows 11 without a Microsoft account. A small “Learn more” link on the sign-in screen used to lead to local account creation, and it took the company about four weeks to turn it into a dead end.
The change came from Microsoft’s own servers with no announcement.
In March, a Microsoft vice president said he hated the account requirement and was working on it.
The company has been working on it too alright...by closing every route around it.

Remember when the backlash over Montana Gov. Greg Gianforte’s trip to India was mocked as a bunch of people who didn’t understand that it was all about exporting lentils? Turns out the critics had reason to be suspicious, especially when the president of Montana State University was along for the ride. Now Gianforte is telling Indian media, in plain English, how these so-called foreign investments will create jobs for foreign workers. Question is, why should Montanans be expected to subsidize an economic development strategy that seems designed to bypass them?
Montana Governor Gianforte in an interview published today.
Is this what we want our state to be, a “beachhead” for replacement of Montanans and our culture, values, and norms?

Remember: there is NEVER any requirement that a company look for an American before hiring an H1B!
Big business lobbyists made sure of that when the law was passed
And universities aren’t subject to the 85k cap- they can sponsor an unlimited number of H1Bs
Congress must end H1B today!

What about this do you think is illegal?
It’s literally just a normal H1B LCA notice that companies do everyday
The problem here isn’t fraud, it’s that H1B allows schools like Oklahoma to give basic jobs many Americans could do to immigrants
Hey, @UofOklahoma, hide the records behind a login. Put up every digital wall you want.
A login screen won’t stop a subpoena.
If you’re breaking the law to screw American workers, we’ll follow the evidence and hold you accountable.

Black people living in Charlotte should be mentioning this every time they get pulled over.
Charlotte-Mecklenburg police officers reportedly had a text thread competing to pull over the most Black drivers, while using racial slurs in discussions about force against Black residents. More than half a dozen officers have reportedly been recommended for termination or quit.
A badge should NEVER be a license for discrimination! These allegations call into question traffic stops and use-of-force incidents involving these officers!

Not a single qualified American can do lawnwork...
This apparently is the genius level talent we are told we're missing in the USA by open borders advocates.

A Berkeley chemical engineer who suffered years of unexplained illness discovered through a spy camera from Amazon that her coworker, David Xu, was poisoning her food and water with cadmium, a toxic heavy metal for nearly 18 months between 2017 and 2019. The victim experienced significant health problems and at times required emergency care at a hospital. Newly released video shows Xu appearing to put a substance in her water bottle in 2019.
Xu was arrested that year and charged with attempted murder and two counts of poisoning, offenses that could have sent him to prison for life. But under a plea deal, the attempted murder charge and one poisoning count were dropped. Xu pleaded no contest to one felony poisoning charge and received two years of probation, with credit for one day served. He completed probation in March and is now seeking to have his felony conviction dismissed.
