Steve Bannon was convicted by a jury.
He served four months in prison.
Then Trump’s DOJ asked to erase the case, saying dismissal was “in the interests of justice.”
The Supreme Court removed an appellate obstacle.
But Trump-appointed Judge Carl Nichols just refused DOJ’s request.
His problem: DOJ hasn’t adequately explained why the conviction should disappear.
Prosecutors can try again.
For now, the conviction remains.
If DOJ wants to erase a completed prosecution of Trump’s political ally, the judge wants the receipt.
