AppLovin has filed for a temporary restraining order against Unity in California, alleging that its rival harvested data through Unity's free Ad Quality SDK without permission.
The lawsuit claims Unity collected auction data from AppLovin's MAX mediation platform, including clearing prices, auction IDs, and waterfall data, then used it to train models that anticipated AppLovin's bidding decisions in live ad auctions.
Unity called the filing "a classic case of a dominant incumbent resorting to litigation and intimidation," and pointed out that AppLovin runs its own comparable tool, Ad Review.
AppLovin wants Unity to stop collecting the data within five business days and modify the SDK within 30.
The two companies attempted to settle first. Unity offered to shut off data collection from MAX-mediated auctions going forward, but AppLovin turned it down because the offer said nothing about data already collected or models already built from it.
It's the latest move in a rivalry that's already seen a failed $20B buyout proposal, an earlier merger attempt, and the Runtime Fee saga. A separate JAMS arbitration is also underway, pursuing claims for trade-secret misappropriation and breach of contract.
