[𝐖𝐡𝐞𝐧 𝐭𝐡𝐞 𝐥𝐚𝐰 𝐢𝐬 𝐢𝐧 𝐭𝐡𝐞 𝐰𝐚𝐲, 𝐜𝐡𝐚𝐧𝐠𝐞 𝐭𝐡𝐞 𝐥𝐚𝐰] On Wednesday, at the Council of the EU, a large majority of Member States backed Spains proposal to write into law that transfers of tax data to third countries shall be deemed necessary for reasons of public interest. Read that again: deemed necessary. No longer assessed, simply decreed. The text also provides that the absence of safeguards in the international agreement does not prevent the transfer. Its title: Safeguards applicable to exchanges of information with third countries. An article on safeguards whose purpose is to do without them. ⚖️ All this while the Court of Justice of the EU is examining thirteen questions on the compatibility of #FATCA with the #GDPR (Case C-804/25). The European Commission and the Council Legal Service both expressed reservations in the meeting on the grounds that the Court has been seised. Member States listened, then discussed the best vehicle to do it anyway. 😠 I am angry, and I believe that is legitimate. For years, we have been told that FATCA complies with EU law. If that were true, there would be nothing to secure. Every new attempt to change the law is an admission. And in all of this, nobody asks the only question that matters: is it right that the banking data of our fellow citizens are sent to the IRS for the sole reason that they were born on American soil? Accidental Americans are not asking for a privilege. They are asking that the Court be allowed to rule before the law is rewritten to get around it. 📰 @ElodieLamer article for @TaxNotes : taxnotes.com/featured-news/e… @EUCssrMcGrath @EU_EDPB @saskiabricmont @MurielleL69320 @fxbellamy @DolorsMM @zarzalejosj @maxschrems @NOYBeu @platombe

Meet John in the United Arab Emirates. He is a born and raised New Yorker who still loves cheering for the Yankees and the Knicks, and he takes genuine pride in being American. But living abroad as a U.S. citizen has turned that pride into a never-ending compliance nightmare. CFC rules, GILTI, PFIC and phantom income tax mean John has spent tens of thousands of dollars to stay compliant, even when his U.S. tax bill is zero. Read and share John’s story: taxfairnessabroad.pulse.ly/7… When he tried to open a brokerage account abroad, he was denied. The list of countries the institution would not work with included Iran, Russia, North Korea and the United States. His U.S. passport, the thing he was always told was the greatest asset in the world, had become a liability. Americans abroad should not have to choose between our citizenship, our identity and basic access to the global financial system. @WaysMeansCmte @WaysandMeansGOP @SenFinance @SenateFinance @YourVoiceAtIRS @RepLaHood @SenToddYoung #TaxFairnessNow #ResidenceBasedTaxation #CBT #GILTI #PFIC #TaxReform #FBAR #FATCA

ABCK–AmCham Kuwait has joined the call for residence-based taxation for Americans abroad. For more than four decades, AmCham Kuwait has supported American business engagement in Kuwait. Its members include companies and professionals working across energy, defense, aviation, finance, logistics, health care, education, technology, infrastructure and professional services. Read and share the full letter: taxfairnessabroad.pulse.ly/t… Their message to Congress is clear: citizenship-based taxation imposes a direct competitive disadvantage on American workers and businesses. When companies send American personnel overseas, they often have to provide tax advisory support, tax equalization and additional compensation simply to offset burdens that do not apply to workers from other countries. Residence-based taxation would help Americans abroad remain globally mobile, support U.S. companies overseas and compete on equal footing in markets like Kuwait. @WaysMeansCmte @WaysandMeansGOP @SenFinance @SenateFinance @YourVoiceAtIRS @RepLaHood @SenToddYoung #TaxFairnessNow #ResidenceBasedTaxation #CBT #AmCham #TaxReform

Apparently, nothing says “summer vacation” quite like spending it gathering bank statements, calculating exchange rates, and preparing another U.S. tax return. 🦅🏖️ Help us fight for a fairer system: taxfairnessabroad.pulse.ly/0… Americans who live and work abroad already pay taxes where they live. Yet the United States continues to tax based on citizenship rather than residence, leaving ordinary Americans overseas to navigate an expensive and complicated second tax system, even when they owe the U.S. nothing. It doesn’t have to be this way. Residence-based taxation would bring the United States in line with the rest of the world and allow Americans abroad to live normal financial lives in the countries they call home. @WaysMeansCmte @WaysandMeansGOP @SenFinance @SenateFinance @YourVoiceAtIRS @RepLaHood @SenToddYoung #ResidenceBasedTaxation #TaxFairness #AmericansAbroad #TaxFairnessForAmericansAbroad #RBT #taxfairnessnow #expats #taxation #Congress #FBAR #FATCA #GILTI #PFICs

A mother in the United Kingdom lost the roof over her children’s heads after U.S. tax rules kept her name off the family home. Read and share her story: taxfairnessabroad.pulse.ly/1… She had American citizenship through her father and lived in the United States for just one year as a teenager. Decades later, U.S. citizenship-based taxation followed her to England and turned an ordinary family home into a tax trap. Because the house was in her husband’s name after divorce, he could sell it. She and her children lost their home. Congress should support residence-based taxation so Americans abroad can build normal lives, buy homes and protect our families where we actually live. @WaysMeansCmte @WaysandMeansGOP @SenFinance @SenateFinance @YourVoiceAtIRS @RepLaHood @SenToddYoung #TaxFairnessNow #ResidenceBasedTaxation #CBT #AmericansAbroad #TaxReform

A summer job worked entirely in Canada should not require U.S. Tax Court, a university tax clinic and a treaty dispute. But buried in a routine 2024 report from the University of Washington’s federal tax clinic is exactly that story: a dual U.S.-Canadian citizen living in Canada, caught in a system that taxes people based on their passport rather than where they live. Read and share our full post: taxfairnessabroad.pulse.ly/j… The clinic invoked the U.S.-Canada tax treaty. IRS Appeals refused because of the saving clause. For citizens, the exception swallows the rule. This is why residence-based taxation matters. We are not asking for a loophole. We are asking Congress to end the taxation of income that has nothing to do with the United States. @WaysMeansCmte @WaysandMeansGOP @SenFinance @SenateFinance @YourVoiceAtIRS @RepLaHood @SenToddYoung #TaxFairnessNow #ResidenceBasedTaxation #CBT #TaxTreaty #TaxReform

Two years ago this month, we launched Tax Fairness for Americans Abroad with the ambition of doing what might have sounded impossible at the time: ending the double taxation of Americans abroad, along with onerous and costly FATCA and FBAR entanglements. @WaysMeansCmte @WaysandMeansGOP @SenFinance @SenateFinance @YourVoiceAtIRS @RepLaHood @SenToddYoung #taxfairnessnow #expats #taxation #Congress #FBAR #FATCA #GILTI #PFICs

Meet Christian, a former U.S. Department of Labor project manager who once dedicated his career to helping American workers navigate economic hardship. Today, living in Germany, Christian says he pays thousands of euros every year to navigate U.S. tax and reporting requirements — even though his regular U.S. income tax liability is $0. Read and share Christian’s story: taxfairnessabroad.pulse.ly/k… From costly compliance and self-employment taxes to banking restrictions and barriers to entrepreneurship, Christian’s experience shows how citizenship-based taxation can turn ordinary life abroad into a financial and administrative minefield. After serving our country, we should not be treated like tax evaders simply because we live outside its borders. @WaysMeansCmte @WaysandMeansGOP @SenFinance @SenateFinance @YourVoiceAtIRS @RepLaHood @SenToddYoung #TaxFairnessNow #AmericansAbroad #CBT #FATCA #FBAR #ResidenceBasedTaxation #TaxReform

⚖️ Tens of thousands of accidental Americans live in Italy. They have never lived in the United States. Most were simply born there. Every year, their bank accounts are reported to Internal Revenue Service. 📨 Today, on behalf of one of them, we filed the first Italian complaint against these transfers. The Belgian data protection authority has declared such transfers unlawful. The Court of Justice of the European Union has been seized of the question. The European Court of Human Rights has just faulted the Italian framework governing access to banking data. It is now for the The @GPDP_IT to rule. Our press release is below.

The United States is celebrating Folarin Balogun, an accidental American born in Brooklyn by chance and gone again at two months old, as a hero of their World Cup. Meanwhile, millions of other accidental Americans, invisible ones, endure #FATCA and taxation based on nationality alone. Yet the solution is already on the table: the Residence-Based Taxation for Americans Abroad Act. It just needs to be passed. @RepLaHood @SenToddYoung @RepLloydDoggett @RepDonBeyer @RepDonBacon independent.co.uk/sport/foot…
