While Section 16 of the Representation of the People Act, 1950 disqualifies non-citizens from being registered as voters, requiring proof of citizenship during a Special Intensive Revision (SIR) acts merely as an essential administrative threshold rather than an absolute judicial determination of nationality. Excluding an individual from an electoral roll during an SIR does not amount to stripping their legal citizenship, as it carries no formal decree of alienage, nor does it trigger deportation or revoke citizenship under the Citizenship Act of 1955. Declarations of non-citizenship remain strictly within the domain of Foreigners Tribunals and the Ministry of Home Affairs, making the ECI's inquiry strictly regulatory for democratic franchise rather than adjudicatory for nationality. Furthermore, disabling the ECI from verifying basic citizenship criteria during revision exercises would render Section 16 unenforceable, compromising the integrity of electoral rolls against fraud while removing essential safeguards upheld by previous Supreme Court precedents.
