I'm writing about a gap in federal protections for our veterans in VA nursing homes. In March 2020, VA placed all 134 of its Community Living Centers under a "No Visitor" policy. For months, veterans went without their families, and many died without them. Today, the right to visitors in a CLC rests only on VA's internal patient-rights policy, which can be suspended at any time. Because CLCs are federal facilities, state visitation laws don't apply to them. The Essential Caregivers Act of 2026 (H.R. 9641), which passed Ways and Means on July 15, protects nursing home residents through Medicare and Medicaid certification. As written, that likely leaves VA's own nursing homes out. I respectfully ask @RepBost, @JerryMoran, @HouseVetAffairs and @SVACGOP to: 1. Amend H.R. 9641 and S. 3492, or introduce a companion bill under Title 38, so that VA Community Living Centers are covered. 2. Urge @SecVetAffairs to issue a VHA directive guaranteeing that every CLC resident can designate essential caregivers whose access continues during any public health emergency. Our veterans earned the same dignity as every American in long-term care. What happened during COVID can never happen again. @RepTenney, thank you for leading on this.
