The hearing addressed persistent health symptoms and challenges in accessing medical care, as part of the ongoing judicial investigation in France. The case stems from a criminal complaint filed in France by chemical attack survivors and SCM, announced in March 2021, with support from the Syrian Archive and the Open Society Justice Initiative, as part of accountability efforts regarding chemical weapons attacks in Syria. 2026: scm.org/trial-of-a-former-is…

The hearings continued in the case concerning the accused’s alleged involvement with IS and his alleged position within the organisation’s security service, the Amni, with the final hearing taking place on September 23, 2026 before the District Court of The Hague, sitting in Rotterdam. The hearing was primarily devoted to the prosecution’s rebuttal to the defence’s pleadings, addressing the admissibility and reliability of the evidence, the identity of the accused, the alleged participation in IS, the nexus between the alleged crimes and the armed conflict in Syria, the alleged war crimes, and the accused’s alleged leadership position. The defence subsequently made a limited response, maintaining that the evidence was insufficient to establish the charges beyond reasonable doubt. The Court also declined to lift the accused’s pre-trial detention. The judgment is scheduled for December 4, 2026 at 13:00 in Rotterdam. Since March 2020, the Syrian Center for Media and Freedom of Expression (SCM) led investigation and tracking efforts regarding the suspect upon receiving information about his arrival in the Netherlands. As part of its ongoing efforts to support international justice and accountability for crimes committed in Syria, SCM played a pivotal role by preparing and submitting a comprehensive complaint file to the Dutch War Crimes Unit in mid-2020. The file included 11 testimonies from witnesses and victims, open-source research, and documentation detailing the suspect's involvement in grave violations. The hearing summary was prepared and shared in collaboration with the Nuhanovic Foundation, based on field notes gathered by its representatives during the court hearings. This summary does not constitute an official court record, and the translation is unofficial, published for informational purposes only, and should not be considered an authoritative legal document. 🔗 Link to the Summary of Day 4 Hearing Monitoring Minutes – September 23, 2026: scm.org/en/trial-of-a-former…

2026: scm.org/trial-of-a-former-is…

The substantive hearings in the Arkel case continued, with the third day, held on September 17, 2026, devoted to the defence’s plea in the case concerning the defendant’s alleged involvement with IS and his alleged role within its security apparatus. The plea addressed the reliability of witness evidence, the identification of the defendant as the person known under the kunya, evidence originating from social media and other open-source material, and material handed over to the prosecution by the FBI. The defence concluded by requesting that the Public Prosecution Service be declared inadmissible. Alternatively, if the case were found admissible, it requested the defendant’s full acquittal on both the membership charge and the underlying war crimes charges.
