Replying to @SkinnerLyle
Party discipline is generally so rigid in New Brunswick that disagreeing with a motion to adjourn the house may be viewed by some as a revolt or a rebellion causing an election. This is very silly and not an accurate reflection of the constitutional order. #nbpoli

Friendly reminder: he can be booted from the party, but he can't be booted from caucus as the Legislature is currently dissolved. There are presently no CAQ MNAs (and there will be none when the Legislature is summoned)

A 1938 federal legal memo discusses the last time a province tried to unilaterally defund all aspects of the office of the LG. After Alberta Premier Aberhart defunded all supplies, PM King sent a letter outlining the essentials of the office. #cdnpoli #cdncrown #abpoli

This is separate from the fact that in order to remove the office of the LG, there is the requirement for Parliament and all 10 Legislative Assemblies. Further the inability of a province to amend the office of LG was agreed to by Quebec upon Confederation in 1867. 92(1), BNA Act

The actual legal memo and letter I have has a lot of redactions; however, given King spoke to the Canadian Press about the contents of the letter, I am optimistic that the information will be released after investigation by the Information Commissioner.

This is exactly what happend when maritime union was first brought up at the Charlottetown Conference in 1864.
Hey great idea... maybe we could replicate this on a larger scale. We might call it... a country.

The role of the leader of a political party is separate from the role of a Premier. If Doerkson can command the confidence of the Assembly, he is Premier regardless of the BC Conservative Party rules for selecting or removing a leader. #bcpoli #cdnlaw
Who would be premier if the Conservatives win? Nobody knows. The people who'll decide are the ones who gave you Kerry-Lynne Findlay.

the first thing on the NDP campaign for Friday. Unclear what they can attack (or why) about the process to make Doerkson leader given he was (until Tue) an MLA, chosen by his own caucus, approved by the party board + Eby called the election knowing their leader had just resigned

👇A good reminder that the leader of the governing party and premier are two legally distinct roles. Doerkson would be Premier because he can command the confidence of the Assembly. He is leader by virtue of the rules of the Conservative Party of BC. #bcpoli #cdnlaw
DOERKSON TO REMAIN LEADER IF ELECTED PREMIER The Board of Directors sets out the Party's position on its leadership should Interim Leader Lorne Doerkson become Premier. When Mr. Doerkson leads the Party to victory on October 24, he will remain Leader. The Board will pursue the appropriate means under the Party's Constitution and Bylaws and the Societies Act to give effect to this intention. A Premier chosen by British Columbians deserves the certainty of leading his party. This amendment will provide it. Board of Directors, Conservative Party of British Columbia

The specific loophole was closed when the Legislature removed the wording of the Premier providing advice to the Lieutenant Governor. The NBCA decision is now moot as the maximum duration of a legislature simply occurs by efflux of time. #nbpoli #cdnlaw
This is insane. The New Brunswick Court of Appeal ruled in 2022 that it was illegal to call a snap election for political advantage reasons, using the logic of Miller II.

Saint Pierre et Miquelon is not a Newfoundland island. It is an overseas collectivity of France.

Kudos to the photo caption writer: "MHA Keith Russell — literally — crosses the floor to sit as an independent, breaking from the PC Party on Sept. 14, 2026."
