After review, we decline the demand for the following reasons:
1. The post reports allegations and images obtained from a third-party source; it does not independently create or authenticate intimate material.
The post attributes the image and related claims to an anonymous source or former associate and presents them in the context of reporting unverified allegations about a public figure. Reporting the existence of a claimed image or description of alleged conduct, while attributing it to a source, is not the same as originating nonconsensual intimate imagery or asserting the image as verified fact. Your notice does not identify the specific image(s), provide evidence of their authenticity or falsity, or establish that the depicted content meets the statutory definition of intimate imagery under the cited laws.
2. First Amendment protections for reporting on public figures.
Sneako is a well-known public streamer and commentator. Coverage of allegations concerning public figures on matters of public interest receives substantial First Amendment protection. Any defamation claim requires proof of actual malice (knowledge of falsity or reckless disregard for the truth). Your notice does not identify particular false statements of fact, supply evidence establishing their falsity, or demonstrate actual malice. Framing material as obtained from a third-party source and presenting it alongside allegations does not automatically convert protected reporting into actionable defamation.
3. Application of intimate-imagery statutes (TAKE IT DOWN Act, Florida sexual cyberharassment, and related provisions).
The TAKE IT DOWN Act and corresponding Florida laws address the knowing publication of nonconsensual intimate visual depictions (authentic or qualifying digital forgeries) under defined elements. These typically require, among other things, that the material qualifies as intimate imagery, that there was no consent to publication, that the subject had a reasonable expectation of privacy where applicable, and (for adults) intent to cause harm or actual harm in many circumstances.
Obtaining an image from a third party does not automatically create liability, nor does it automatically immunize republication if the statutory elements are otherwise met. However, the mere fact of republication does not establish those elements. Your notice does not demonstrate that the specific image(s) constitute protected intimate imagery under the statutes, that they were published with the requisite knowledge or intent, or that any exception (including good-faith reporting or matters of public concern, where recognized) is inapplicable. The statutes do not grant a blanket right to suppress all reporting or imagery concerning a public figure.
4. Overbreadth of the demand.
The demand to remove both the images and the accompanying allegations is overbroad. Protected speech concerning public figures is not rendered unprotected simply because it involves sensitive personal allegations or images obtained from a source. The notice appears designed in part to create a record of notice, which is relevant to malice analysis but does not convert the content into unprotected speech or establish liability.
5. Evidence preservation.
We will preserve relevant materials in our possession or control, including any original files, metadata, and communications with sources, consistent with ordinary practices. We expect reciprocal preservation by your client and your office of all related records, communications, claimed material, and the factual basis for any denials or assertions regarding the images.
Nothing in this response concedes the authenticity, origin, accuracy, or status of any image or the truth of any allegations.
We remain open to a more specific discussion identifying the particular image(s) and statements you contend violate the cited statutes or are false and defamatory (with supporting evidence). The broad demand for immediate removal is rejected.
Don’t watch the stream tonight or sign up for the costume contest. This monkfish deserves to be blackballed for lying
