DOES LOBOLO MEAN YOU'RE MARRIED?
Donda Attorneys Inc article .
Every week someone walks into our offices believing that once lobolo has been paid, a marriage is automatically valid in the eyes of the law. It's an understandable assumption — lobolo sits at the heart of how many of our communities understand marriage. But under South African law, it's not quite that simple.
WHAT THE LAW ACTUALLY REQUIRES
The Recognition of Customary Marriages Act says a valid customary marriage needs three things:
1. Both people must be 18 or older, and both must consent to the marriage.
2. The marriage must be negotiated and entered into according to customary law.
3. It must be celebrated in accordance with customary law.
Lobolo negotiations are usually the strongest evidence that a family intended a real marriage to happen. Courts take lobolo seriously. But paying lobolo, on its own, has not always been treated by the courts as proof that a marriage was fully concluded.
THE HANDING-OVER QUESTION
The part that catches families out is the "celebration" requirement — traditionally understood as the handing over of the bride to her new family, or an agreed ritual standing in for it. Courts have not spoken with one voice on how strictly this must be applied:
• Some judgments have accepted that once lobolo is agreed and some form of handing-over or integration ritual has taken place — even a scaled-down one — the marriage is valid.
• Other judgments have required clearer proof that the full custom, as practised by that specific family or community, was actually carried out.
Because customs differ from family to family and region to region, the courts have generally said the specific family's own understanding of its customs carries real weight — there's no single national checklist that overrides how a particular family does things.
WHY THIS MATTERS
This isn't just an academic question. It becomes critical in:
• Divorce proceedings, where one party disputes that a valid marriage ever existed
• Deceased estates, where a surviving partner's inheritance rights depend on the marriage being recognised
• Maintenance and pension claims
• Disputes between a customary marriage and a later civil marriage
If a court finds no valid customary marriage existed, the surviving or separating partner can lose rights they believed they had — to property, maintenance, or a share of the estate.
WHAT TO DO
If you are negotiating lobolo, or you are in a relationship where lobolo has been paid but you're unsure of your legal status, get advice before a dispute arises, not after. Keep a record — who was present, what was agreed, what rituals were performed and when. This evidence is often the difference between a recognised marriage and a painful legal dispute later.
