People need to read the case and ruling more carefully. Based just off this article's info what has been ruled is that scraping a paid copyrighted product for the specific purpose of developing an AI product that directly completes with that product is a violation.
Also even from the perspective of "performance" it's not ideal to be at max intensity all the time. Be chill sometimes, pop off other times imo.
I'm sorry but if I start watching a vtuber for the first time and they're "puppeteering" at me I just turn off the stream. I want to hang out and chill with someone, not have them spam Disney face at me. Not everyone watches for the same reasons.
I too prefer my stories delivered to me as a list of happenings. Don't give me all that inconvenient thematic narrative I have to journey through. I just need to know: does the villain defeat the pathetic heroes?

I see so many people online saying "horizontal progression" with the weirdest definitions. Like, ok, use words how you like, but what is horizontal about having BIS items for all content "but they won't raise the level cap!" uhh... ok so what? Thats vertical bro.
Also just think about the incentive structure for any subscription service like this (i.e. all of them that aren't just you voluntarily funding your fav creators). The less they give you the more money they make.
