🚨 TOMORROW IN THE SUPREME COURT: MARITAL RAPE CASE Why supreme Court is behaving like Parliament? A 3-judge bench headed by CJI Surya Kant, along with Justices Joymalya Bagchi and V. Mohana, will hear the Centre’s stand on a batch of 8 matters challenging the marital rape exception. The issue reached the Supreme Court mainly after the 2022 Delhi High Court split verdict. One judge, Justice Rajiv Shakdher, held the marital rape exception unconstitutional. Justice C. Hari Shankar took the opposite view and upheld the exception. The Supreme Court is now dealing with the constitutional challenge, along with other matters — including an appeal involving prosecution of a husband for alleged marital rape under Section 376 IPC. The exception essentially protects a husband from being prosecuted for rape for sexual intercourse/sexual acts with his adult wife. Tomorrow, the Court will first hear what the Union Government has to say before fixing the date for final arguments. And this is where the biggest concern for husbands begins. If the exception is removed, a husband could face a rape prosecution based on an allegation arising from within the marriage. In a country where matrimonial criminal laws are already accused of being misused, creating another extremely serious criminal weapon without equally strong safeguards can destroy innocent men and their families. A wife’s allegation cannot become automatic proof. Presumption of innocence must apply to husbands too. Don’t create a law where a husband has to prove his innocence after his life has already been destroyed. ⚖️ Tomorrow’s hearing deserves everyone’s attention.
