Historically, most copyright infringement cases in regards to pirating etc have been brought against the distributors of said content. Rarely have end users been prosecuted for "owning" illegally shared content.
Doubtful. Owning an NFT doesn't actually make you owner of the Rights of the content. It's like owning a print of a famous photograph (even if reproduced illegally), you probably won't be on the hook unless you're also the one who printed and distributed said bootleg photo.
