Rep. Ilhan Omar’s 2009 marriage to British national Ahmed Elmi, long alleged to be her brother, will not get her deported by itself, immigration officials told the New York Post. A U.S. citizen generally cannot be removed just for a sham marriage. Criminal marriage-fraud charges also hit a five-year statute of limitations. Officials say that clock ran out after the 2017 divorce. That path is a dead end. That is not an accident of timing. These allegations were public in 2016, when Omar first ran for office. The Obama-era U.S. Attorney in Minnesota said at the time his office was not investigating. Trump’s first term talked about it and never brought a case. Biden’s DHS sat on it. Year after year the criminal clock on the marriage ran out. What does not expire is civil denaturalization. Federal investigators are now focused on how Omar became a U.S. citizen as a teenager in 2000 and what her father submitted during the family’s naturalization, not the 2009 wedding. DHS Secretary Markwayne Mullin said the probe covers “the whole family migration” and “possible illegal activity” in how they entered. Border Czar Tom Homan confirmed ICE/HSI is looking at it and said no one is above the law. Mullin put it bluntly: if they lied on the applications, “there’s no expiration to that.” Omar denies Elmi is her brother and called the claim “disgusting.” No public DNA test, court finding, or released file has proven the sibling claim. That does not erase the paper trail, the years of delay, or the live question on her citizenship file. Criminal charges on the marriage may be timed out. Citizenship obtained by fraud is not. If the file shows material lies, denaturalization is still on the table. No one is above the law, including a member of Congress.
