In 2020, NH became the first state to legalize flying cars. Six year's later, Tesla demonstrated a "flying" Roadster. Yet NH's law doesn't cover the Roadster. Even our innovative law didn't foresee this new tech. Regulatory sandboxes offer a better way.

This case asks the basic question: If an individual person is treated worse by government policy on the basis of their race, is it magically ok because other people who look like them weren't harmed? In other words, are they a person or just an avatar for their skin color?

2/ The court granted Association for Education Fairness v. Montgomery County Board of Education to consider whether when challenging a facially neutral admissions policy as racially discriminatory must establish that the targeted racial group suffered a disparate impact.

@PacificLegal is heading back to the Supreme Court! This morning the Court granted our petition in Association of Education Fairness v. Montgomery County Board of Education. Despite the repeated Supreme Court cases holding that schools can't discriminate based on race, they use sneaky tactics in their admissions criteria to keep on discriminating. Here, magnet middle schools tinkered with their admissions criteria to reduce Asian American enrollment. The petition asks the Court to address what a plaintiff must do to demonstrate that a policy that looks neutral is hiding discriminatory motives. Congrats to my colleague @ckieser13 and the rest of the litigation team!

"Guidance" should never be binding, but agencies often treat it that way. This mass of material is created in the shadows, outside any formal process. A report by @PacificLegal and @StatePolicy makes the case for curbing the abuse of agency guidance: pacificlegal.org/research/go…

Baby boomers are the wealthiest generation in history. We should absolutely help low-income seniors. We should *not* ask younger, poorer people to foot the bill for richer Americans. Why should working-class people subsidize millionaires?
“I’m old. I’ve paid my home off,” said Ray Warner, a 72-year-old Akron resident. “Why would I pay property tax?”
Across the country, homeowners are asking the same question and revolting against property taxes at a scale not seen in a half century.
