The word "historic" is thrown around a lot, but Friday's ruling halting wall construction across Big Bend truly made history. In the 21 years since the REAL ID Act was passed, more than a dozen legal challenges have been filed by almost as many different groups. And we've lost every single time. Not once has a federal judge ever issued an injunction like this.
To put it into perspective, this decision slams the breaks on $7 billion in federal contracts given to politically connected construction tycoons and campaign donors. It restores dozens of our nation's most important environmental, public health and cultural protection laws to more than 500 miles of the U.S.-Mexico border. It stops the bulldozers from again tearing into Big Bend National Park, which DHS's own attorneys told our judge they were planning on doing next week.
Another fascinating element here: the legislation authorizing DHS's waiver authority explicitly prohibits appeals court review. This was meant to make it nearly impossible to challenge the waivers, but in a poetic twist, it now means DHS can't appeal this injunction to the 5th Circuit—only directly to the Supreme Court.
Whether and when that might happen is a big question mark. And how the Supremes might rule is another.
It ain’t over yet, but we absolutely should savor this win—it belongs to every single person fighting so relentlessly to save the wildest corner of Texas.

Yesterday’s historic win stopping wall construction across the whole Big Bend region still hasn’t quite settled in, but we figured we’d get right back out in the field today anyway. Got a tip that a section of wall outside of El Paso had been severely flooded over the last two weeks of hurricane rain, so headed out to investigate this morning with Natalie Newman.
What we found was an geomorphological nightmare where erosion had cut 10-15 deep into a hillside, while also piling up a ton of earth against the wall—so much that it basically overtopped the wall itself. The border wall always seems so surreal, so ridiculous and so futile. At times like this, up against the persistent force of nature, it’s also just comedic in its absurdity.
We will keep doing every single thing in our power to make sure these ridiculous, destructive barriers are kept out of Big Bend for good.

On March 9, 2026, a federal jury UNANIMOUSLY convicted ALL THREE on EVERY COUNT.
Seven months later, they still haven’t been sentenced.
Now their wealthy Jewish family has hired Alan Dershowitz, Jeffrey Epstein’s and Trump’s former lawyer. Dershowitz’s correspondence says his work includes exploring “executive clemency and judicial reversal.”
These men aren’t accused. THEY’RE CONVICTED.
Yet this story has received nowhere near the sustained national attention its scale deserves.
October 27 is Sentencing day.

Using a fake name, the son of a man pardoned by Trump for federal tax crimes gave $250K to Ken Paxton, as well as to other Republicans. Paxton has previously called Ben Pogue's father, who owns a construction biz in his home town, a "family friend."
