In a 6-3 decision, the Supreme Court held that district judges generally may not issue nationwide injunctions that halt federal policies across the United States for parties not party to the litigation. Writing for the majority, Barrett stated: “Justice Jackson, however, adopts a surprising line of critique that lacks grounding in established sources or recognized doctrine. Characterizing concerns about judicial authority as ‘mind-numbingly technical,’ she proposes a conception of the judicial function that would challenge even the strongest proponents of judicial supremacy.” Barrett continued: “We will not elaborate on Justice Jackson’s position, which conflicts with more than two centuries of precedent and the Constitution itself.
