Was sat in the Stretford End for this. Had to immediately exit my seat and head down to the concourse to celebrate with a very confused steward 🤣

That's the major relevant points of disagreement between the majority and the dissent. So what's next? Oregon could take this to the en banc 9th Circuit, which could put Judge Immergut's order back in effect. Or they could go to the Supreme Court

Judge Graber strongly disagrees with the idea that the majority adopts that an invocation of 10 USC 12406 is untethered to the facts on the grounds before the invocation.
She thinks the inability to execute the law must be occurring at the time of invocation, not months earlier.

Unsurprisingly, Judge Graber "strenuously dissents" from the majority opinion. She accuses the majority of eroding "core constitutional principles" and says there is no evidence ICE was unable to execute the laws in the days before Trump federalized the National Guard.

There are three major points of disagreement between the majority and Judge Immergut (+ today's dissent).
1. What period of protests was relevant
2. What the facts say.
3. What it means to be "unable" to execute the laws
Below is a thread on her order.

Here's how Judge Immergut summarized the last two and a half months of protests at the ICE facility in Portland; they "generally were limited to fewer than 30 people and were 'largely sedate.'"
Stephen Miller's efforts to claim insurrection in this decision is pure propaganda.

🚨2-1 panel of the 9th Circuit (2 Trump vs 1 Clinton appointee) permits Trump to deploy the National Guard in Portland.
The majority finds that Trump could consider the situation from June through September, and declares the ICE protests disruptive enough to justify the Guard.

"For more than an hour on Wednesday, several armed ICE officers outside a Portland-area apartment repeatedly shouted a man’s name. A 24-year-old mom and her 3-month-old baby were inside, along with her stepfather and brother. None of them recognized the name that the ICE agents were yelling, she said. The family didn’t come out. But the officers finally came in, pushing through the apartment’s locked door and then busting into the bedroom with rifles drawn. They arrested the brother and the stepfather, the woman said. Neither was the man that agents were seeking."

Regrettably the High Court has today ruled that the GMC isn't legally required to set a safe scope of practice for assistants.
The GMC should take no comfort in this. Doctors are clear; without a national scope of practice patient safety is at risk.
We're considering next steps
Sorry to say our judicial review was dismissed on all grounds.

•Who paid $10,000 bond?
•Did he leave US legally?
•Why did @IsraeliPM lie about his arrest?
