LIL DURK UPDATE: @LAmag
Durk’s defense team has requested a bond hearing following his most recent trial, where he was acquitted on all five charges relating to alleged stalking and a murder-for-hire plot.
The bond hearing has been requested for Nov. 4, 2026.
Durk was previously set to face a second trial on Oct 5, where he is accused of running a criminal enterprise that led to Saviay’a Robinson’s death. This most recent hearing request suggests Durk’s new trial will not begin in October and will be pushed to a future date.

This update is not a huge surprise, as it was expected that Durk’s defense would likely make a new request for Durk be released on bond following his acquittal.
As for pushing the trial date — these additional charges were brought by the government late and very close to Durk’s murder-for-hire trial. The defense has had a limited amount of time to build their case and call witnesses to combat the government’s claim that Only The Family is a criminal enterprise run by Durk.

Lil Durk was found not guilty on all five charges in his murder-for-hire trial — but the win for the defense did not secure the rapper’s freedom.
Lil Durk, whose legal name is Durk Banks, is now facing additional charges in an October trial, where the government alleges that Banks was the leader of a criminal organization it calls the “Banks Gang Enterprise.”
The new indictment charges Banks with murder in aid of racketeering, commonly known as a VICAR charge. To prove the charge, prosecutors must prove that Banks and his co-defendants committed murder under California law and that the killing was committed to maintain or increase their position in the alleged criminal enterprise.
The additional charge is the government pursuing a different legal theory: They allege Robinson’s death was a murder committed to further Banks’ alleged criminal enterprise.

That's about 45% below the top. Now look at the rest of the top 5: ETH is ~50% off its high, XRP ~62%, SOL ~65%. BNB has held up better than every other major alt through this whole drawdown. Relative strength like that is not an accident.

🚨 Judge Fitzgerald previously QUESTIONED the government’s additional charges against Lil Durk, pointing out that this wasn’t the result of Chicago federal prosecutors investigating Durk and his music business for years, but instead stemmed from the Los Angeles case.
Now Durk has been found NOT GUILTY on every charge in that Los Angeles trial. 👀

Here are the four alleged gang-related incidents the prosecution will use to argue their case against Lil Durk in October:
In February 2019, prosecutors allege Banks and others attempted to kill a person in Atlanta, Georgia, after a dispute involving a stolen car.
It is then alleged in the indictment that Banks and others attempted to kill Bowman in Blackshear, Georgia, in May 2021, which Kavon Grant testified to in the first trial.
The prosecutors also allege that a rival gang member, identified only as Victim 2, was murdered in Chicago on Jan. 27, 2022.
Finally, the murder of Saviay'a Robinson will once again be a focus, as the prosecution aims to prove Durk's leadership in OTF led to the death of Robinson.

Judge Michael Fitzgerald will be the same judge presiding over Lil Durk's October trial. He had an interesting way of describing the prosecution's additional indictments:
“This very much is the result of what happened in Los Angeles, and this Third Superseding Indictment indisputably is just an attempt, I'll say from a legal point of view, a very clever one, of having the Chicago tail wag the Los Angeles dog,” Fitzgerald said before severing the indictment in July.
David Lindsey and DeAndre Wilson have not been sentenced for the three stalking charges they were found guilty of. The judge will determine their sentences following the result of the second trial. @LAmag

In this new charge Lil Durk is facing, the government alleges that Banks was the leader of a criminal organization it calls the “Banks Gang Enterprise.”
The additional charges do not constitute double jeopardy because Durk is not being accused of the more narrow murder-for-hire allegation like in the first trial. Instead, they rely on a different legal theory: that Saviay'a Robinson’s death was a result of Durk’s alleged "criminal enterprise."
Prosecutors say the alleged criminal organization grew out of the music label OTF and used violence, money, drugs and other benefits to maintain its power and retaliate against rivals.
While September’s trial focused on the Los Angeles hit hit on Quando Rondo, and ultimately the murder of Saviay’a Robinson, the third superseding indictment Banks will face in October focuses on a larger-scale operation, with crimes from Chicago and Georgia being linked to the group by prosecutors - this is where some confusion has come in.
Durk is not being charged with additional murders in Chicago and Atlanta. Instead, those murders are being used by the prosecution as proof of OTF's gang activity. @LAmag

Durk Banks and co-defendants Deandre Wilson and David Lindsey are also facing Murder in Aid of Racketeering (one of the most serious federal charges involving alleged gang-related violence) along with a related firearms charge. Prosecutors modified the existing gun count to tie it directly to the newly added racketeering-murder allegation. Those charges were severed from the murder-for-hire case and are currently scheduled to go to trial in October. #LilDurk
