When Chairman Issa's siteblocking bill dropped with a thud last week, Big Content was eerily quiet about it. Turns out it wasn't draconian enough for them - they wanted a bill with even less protection for the public, and here it is: the "DEFEND IP Act." NOPE.
The DEFEND IP Act is an attack on the open web. 🌐 By forcing ISPs to act as copyright censors and streamlining site takedowns, this bill risks wiping out lawful small businesses, non-profits, and educational sites overnight. They're right! The brief hits all the high points quite well, leaning appropriately on the Constitutional purpose of copyright and the compelling analysis in the Google Books case. Plus, a stern rebuttal of the wildly mistaken "market dilution" argument.
The Trump Administration files a statement of interest in the copyright lawsuit brought by The New York Times against OpenAI, taking the position that it’s fair use to train an LLM on copyrighted text.

ENORMOUS: @MIT_CSAIL has just blown a hole that size in every gen AI © suit basing liability for outputs on whether an image was used for training a model. FINDING: Removing an image from a large dataset does NOT affect whether it can be (re)generated!🧵 xitter.cf/MIT_CSAIL/status/20901…
New MIT paper finds that you can can delete an artist from an AI model's training data & nothing changes. CSAIL engineers also observed that it's hard to trace AI-generated images to specific data. Their work raises new questions about AI copyright: bit.ly/3U6ZncH

if we don’t figure out fair use in training AI at the input layer the united states will cede its position at the technological forefront to jurisdictions who have. this is the most important situation to monitor rn but it’s boring legal and political stuff so most don’t get it.
There are now 131 copyright lawsuits v. AI companies in the United States of America. ROSS is the first one.

Pat and Peter are my heroes, and I'm proud to have Peter as my law partner. Their work on fair use has brought so many communities out of hiding and fear and enabled them to do more, better work, starting with filmmakers but growing to 18 (!!!) fair use best practices docs: cmsimpact.org/report-list/co…
💃 Copyright uncertainty can keep culture out of public view, even when it's been preserved. In RECLAIMING FAIR USE, copyright scholars Patricia Aufderheide & Peter Jaszi join Dave Hansen to explain how communities can put fair use into practice. One example: after the dance community developed a Code of Best Practices, archives began confidently sharing excerpts of historic performance footage online. 📚🎞️ Hear Patricia Aufderheide & Peter Jaszi with Dave Hansen on the Future Knowledge #podcast. 🎧 Listen & subscribe: futureknowledge.transistor.f…

Michelle Obama: We simply don't have the luxury or time to be cynical or complacent, to wring our hands in despair, or to wait for someone else to fix the problem. Hope is all we have, because hope is the essential spark that lights the fire of change. But hope is a choice. Whether or not we use our voices to speak up is a choice. Voting is a choice. Being a decent human being is a choice. Believing that we still hold the power to build a country that reflects us all is a choice.

I’m leaving the Capitol at 4am after Republicans rammed through a vote paving a path for $70B to fund ICE for years without any reforms/accountability. They rejected all Dem proposals to lower your healthcare costs, housing, and gas prices. Spread the word. We need to stop this.

The Internet Archive and WayBackMachine has been such an essential tool in archiving information and looking up anything relevant for #OSINT research. This threat to shut it down using copyright excuses is really bad, and must be stopped
Destroying the @InternetArchive's @WayBackMachine would be the equivalent of the burning of the Library of Alexandria - one of the worst losses of knowledge in history. Media giants are now threatening to do this. We can't let this happen. Pass it on.

I’ve introduced Articles of Impeachment against Pete Hegseth for violating his oath, endangering U.S. servicemembers, and committing war crimes, including attacks on civilians and a girls’ school in Minab, Iran. Only Congress can declare war; his actions demand immediate removal.

Like Rodney Dangerfield, the second factor gets no respect. It deserves better. The Second Circuit’s Judge Pierre Leval, in Authors Guild v. Google, neatly summed up the view of nearly every court that has taken up a fair use question: “The second factor has rarely played a significant role in the determination of a fair use dispute.” At best, most fair use opinions devote no more than a couple of paragraphs to the second factor. authorsalliance.org/2026/02/…
